  • Hi

I'm desperate to find details for a flight that was delayed from Tunisia (Monastir) to Birmingham (BHX )Sunday 9th August 2009. It was delayed by 24 hours in total, due to a technical fault. I know it's a shot in the dark, but was anybody else on this flight and had any success in making a claim?

I have no details and no receipts/tickets/boarding cards as was booked in the shop.

    Any advice for me?

    Thank you in advance

    Except that:

    A) the airline hasn't moved house; and thus
    B) the change of address should not be used to try and reopen a default judgement (which is what the OP suspects this is about).
And the airline must be well aware in the current flurry of claims that papers will be served on their registered address and have a system in place for their prompt and timely transfer.
In the OPs case they ahve had more than adequate time to inform of a change of address and submit an acknowledgement/defence.

Aside from having a read through the FAQ's and the posts in this thread:

    1) You don't need receipts/tickets/etc. A £10 subject access request will prove you were on the flight.

    2) What details are you seeking? Lots of people have no idea why their flight was delayed unless they start legal proceedings (and even then sometimes they don't find out).
  • Why don't you just stick to the registered offices at peterborough?!!!!

Just passing on our experience? We have had replies to letters sent to here.
  • Hi Everyone

Would just like to thank you all for your help.

I received a voucher from Thomas Cook for £1069 after being delayed for only 5 hours in Egypt last year. I just asked them for a bank transfer and money was in my account 7 days later.

Hope you all have the same success.

    :) x

Can I ask which flight and on what date?
  • Caa as finally got back to me they have sent it back to TC to look at again if after 8 week they havnt contacted me I've got to contact them don't think I'll be waiting that long going to request a warrant

Hi all - spent the last 5/6 months battling TC - incidentally each time I received a response from them it had a different case no! Continually refused comp, until I got the CAA involved about 8 weeks ago - though and behold received voucher for £1749 in post today - will be requesting cheque!! Keep persevering!

I have just caught up with this thread - I spent months chasing this after we returned home in July 2010 - and was refused. Now 3 years down then line -and absolutely no documentation (I have since deleted/shredded everything) I need your advice and have pm'ed you. Hope you don't mind :o

Wait, I thought you were asking about when to enforce a judgment by default previously. So did the court send to the CAA or is this seperate to the court thing as in that's how long it took the CAA to move their butts?

I figure the CAA are overwhelmed now so why bother.
  • I have successfully persuaded Thomas Cook that I am due compensation for a delayed flight dating back a few years.

But instead of returning cash (family of 4, 3+ hour delay = £880), they have instead issued me with a CREDIT NOTE that I am told lasts 12 months and of course can only be used toward a ... Thomas Cook holiday.

I was under the impression companies were to return hard cash to those affected, not credit notes??? I really don't want to use their services again, and it strikes me that others have received cash, so how might I go about getting them to do the same for me?
