I was on the flight from Kos that was delayed nearly 6 hours plus 2 hours spent at the airport. Had to ask th TC rep about refreshment voucher & told to go to the taverna across the road, he did,nt offer or mention that we were entitled to phone/fax/email.But he did say that as we were flight only passengers that it was too bad as the people that had a package had all been told to stay in resort & they would be picked up later so basically tough !.The refreshments on offer ( & I use the term loosely ) a toasty & drink to the value of 3 euros.So I sent off my complaint/compensation claim and guess what? I'm not getting anything as it was a technical nature that were extraordinary- surprise surprise.So I'll send off my claim to the CAA but I'm not holding my breath as last year I was delayed 5 hours again with Thomas Cook & the CAA believed what TC told them & I got nowhere.Anybody else had any luck be interested to know.

Hi could anyone tell me if they have claimed for the above or were on the flight. I checked on flight stats around 6 months ago and I confirmed the delay was over 3 hours. I then put my claim in and have had numerous correspondents with the last one saying the flight wasn't late. I have checked flight checker today and the flight is listed as taking off at 8.15pm and landing at 11.57pm on the 11th July. I was on that flight and it was due to leave at 12.20 am on the 12th July and to arrive at 4.25am. It actually arrived at 7.41. I have checked to see if there were any other flights the day before or after with Thomas Cook and there are not. Can anyone tell me where I go from here ?0

Hi Sorry but I am new to this site and not sure how it works. However any advice regarding the issue below would be gratefully received.
Hi we travelled from Newcastle upon Tyne to Bourgas Airport,Bulgaria on 14 June 2013 with Thomas cook. On our return journey we were 13 and a quarter hours delayed. Our return flight was scheduled for 03.45 am, whilst we were waiting to check in a TC rep asked us to go out of the airportand he would speak to us all. We weretold that the inbound flight had not yet left Newcastle and we were to be takento a hotel; we were told we would fly at 13.50 that day. We arrived at our hotel and checked by 05.30am,breakfast was 8.30 and we were being picked up to go back to the airport at10am. We had very little sleep, the buspicked us up at 10.20 (20 mins late) and we did not take off until 17.10. whilst waiting to board we were given asandwich and a drink. We arrived back inNewcastle at 18.45pm. (13 and a quarterhours late) We heard on the plane from aairhostess that the plane scheduled to pick us up was STILL in SPAIN. It had never been to Newcastle; this crew hadbeen called out from Manchester in the morning to bring out the holiday makersfrom Newcastle and take us home. we havewritten numerous letters to TC asking for compensation and details of the delay tono avail. We have now received a noncommittal letter saying sorry for the inconvenience, no reason for the delayother that out with their control.
Anybody know what the next step should be? A no win no gain solicitor?? or the CAA. Any advice gratefully received.

Next step = read through this thread starting page one.
NWNF solicitor = up to you if you do not feel capable of dealing with claim yourself.

I think you will find most people here are happy to help so long as you do a bit of homework and avoid asking questions that are answered in the FAQ or forum thread. The search button is also really useful. Sorry to be harsh but this kind of thing frustrates those of us who do put in the time to read everything.0 -

CAN ANYONE ADVISE PLEASE?
My flight on the 10/08/13 from Newcastle was delayed 15 hours apparently due to an oil leek on one of the engines. They had to "drive" a part up from Manchester to repair it.
TC are saying Unforeseen Operationally Significant Defect.
Do I have a case?

Due to fly at 12.05, sat on plane for hour told problem with air conditioning. Then taken back to gate told would update at 15.30 so taken back to departure lounge. Back to gate to be put on another aircraft, flown to Gatwick where would pick up new crew to fly to Tenerife. This was a free for all as passengers were told they could sit anywhere even though we had paid to reserve seats in row 8. Landed at Gatwick at approx 18.00. New crew just boarded when announcement by Captain " we have smoke on left hand side of aircraft, everyone needs to leave the aircraft, get out now" this caused complete panic! My party of 5 were now sitting in row 33,
in the panic a passenger opened the emergency door which released the escape chute. My elderly parents were both injured as they landed on the Tarmac. They were both have medical reports from a paramedic. After another 2 hours we had to go back through passport control collect our luggage and queue for 2 hours in the entrance tunnel to stay a short night in the Hilton. Eventually at 07.00 on the 24th we took a third plane to Tenerife landing at 11.30.
Was told by one of Thomas Cooks stewards the first aircraft had a problem on its previous flight and in fact they had been waiting for part to arrive, nothing to do with air conditioning. They took a gamble it would be fixed in time, which did not pay off!
I am looking to claim for the delay. Does anyone know if I could claim for the injuries to my parents as I have been told the Captain did not give the code for the chute to be deployed. If we had been sat in our reserved seats we would have disembarked via the front door thus with no injury.

Just trying to put you off. Make sure you point out to the Judge that you tried to mediate and TC refused.
Yes you should get notification from the local Court of what they require you to send in (serve) and a suggested date. The Order may well request you submit your hearing fee.
The court wrote back to Thomas cook in my case and said in not so many words they were to re consider mediation and if they didn't and won they would not be able to reclaim there costs0
