    I sent TC the standard letter for a flight that was delayed in 2010. I received a letter today from them acknowledging the delay and lots of apologies and explanation as to what they do to minimise delay but an offer in line with regulation 261 please find enclosed offer of compensation of £1052.

    Why only partial success I hear you ask, well they have paid the compensation with a Thomas Cook gift voucher! I will contact them tomorrow to ask for the cash.

    Has anyone else had this offered or know if they can do this?

    Forgot to say that perhaps crucially I did complain at the time on return from my holiday under this regulation but got fobbed off
  • We were delayed in Aug 2011 for 8+ hours on return from Lanzarote. I emailed TC using the template provided here and received the standard reply stating it was too late to complain etc. I thus replied asking for confirmation on their position with regards this ECJ ruling. I received another reply saying they were looking into the issue and would be in touch soon (this was back in November). I chased them last week (again by email) and today received a voucher for £1400 (for 4 passengers). To be honest I am completely shocked and surprised we received anything...as much as we could argue for more and/or cash we have to keep things in perspective. Our delay was not nice (particularly with 2 young children who arrived home at 3am rather than 7pm) but the flights cost a little over £1200 and we have received a higher sum than this. The fact its a voucher is a great excuse for a holiday...which we are planning as of today! We are very very happy at this unexpected outcome.

    But wouldn't 4 passengers have equalled €2,400 cash in total (€600 each), approx £1920 in todays exchange rate?
  • Mark2spark, as I said yes possibly but really, when you consider that a delay is a delay regardless of cause, the fact we have been entitled to claim is a bonus.
    As much as we are over the moon at receiving this voucher, honestly, in our heart of hearts is it proportional to the issue? I dont think any of us could say it is. We flew outbound with no problems, we flew home much later and highly inconvenienced but with no real other consequence and we receive more money than paid.
    I cannot imagine TC (or others) will sit on their laurels legally with this and are still actively looking for ways to counter the judgement, we will be spending the voucher and will enjoy the free holiday......

    I'm hoping you could give me some advice on claiming compensation, I will keep it quite brief,
    Going back to July 2007 myself , husband an 3 children were delayed for 15 hrs marmaris to Manchester, we were told after 3 hr delay that we had to go to a hotel 1hr away, till next available flight.
    We were told flight was cancelled due to the plane needing a new part that had to be flew over from uk. It was 2am in morning when we arrived , there was no food or drink available, my children were also very sick one of them being disabled , it was confirmed a few days after we arrived home they were suffering from salmonella food poisoning which they'd picked up on complex along with other guests. My children went without food an drink for many hrs as the hotel catering department was shut, there were no nearby supermarkets . My question is could I claim for the suffering that this cancelled flight incurred on my family . Thanks

    More than 6 years = out of time to commence court action.

    Therefore no is the answer to your question.

    The set level of compensation was determined so that an abundance of court cases were not set in motion so as to determine the level of inconvenience suffered by each passenger, which would obviously differ.
    Previously my sister arose at 6 am and left for Heathrow for a 09.20 flight to Paris for a (Paris time one hour ahead) 12.30 business lunch. Boarded, pushed back, taxied, - and then sat there for 2 hours 15 mins. So the business meeting was missed before she had even departed, and there was no point whatsoever in taking the journey. But she had to, and then just turn around and come home again on the booked flight 17.00, arriving home at around 7 pm. A completely wasted day, fares, car park fees.
    So on the face of it you are at the better off end of the scale of compensation. Perhaps if you'd had to sleep in the airport overnight - inc the kids - with no food or drink, for the same level of compensation then you'd view it differently.
    IMO the level has also been set so that it's actually quite important for the airlines to try and address delays more sincerely. If the compo level was £25 pp then nothing would change.

    Lots of people are given the vouchers first as if that's it. You are entitled to cash. Vouchers might be better for some people though?
