Centipede, many thanks for responding. before i proceed with the template etc, though i will add the full details of the delay.
Our flight left manchester on time on route to tunisisa, however within and hour the flight had to be diverted into Gatwick Airport as the cabin crew reported smoke and a smell of burning coming from a chiller. I heard one stewardess mention that she wouldnt be sticking around until the problem was fixed as she was out of hours.
we then had to stop in a cold gatwick airport from roiughly 2300hrs to 0930hrs until the problem was fixed and new crew found. Apparently the problem was fixed early hours of the morning but there was no crew (though i cant prove this).
Therefore we had a big delay and also the plane shouldnt have took off from manchester as it was unsafe and there could have been a fire.

Well it just shows that they are lying in at least one instance. I was wondering if there was scope to 'join' your cases together?

Hi, after previous advice on here from Centipede100 and blondmark (Thanks by the way). I gave TC an LBA and one last request (my fourth) to either give me compensation or the details of the root cause of delay.
I got this back the next day:
"We are not able to provide you with the answers to the questions raised in your correspondence detailing the cause of the breakdown as this is a private matter to be addressed by Thomas Cook.
The cause of the breakdown could not have been foreseen prior to your aircraft departing and for that reason, we class this flight delay as an ‘extraordinary circumstance’ and no compensation would be applicable.
We, as Thomas Cook, stand by our decision and should you wish to pursue this matter further, I would therefore suggest that this is done through more formal channels.
I thank you once again for taking the time to contact Customer Relations and whilst I appreciate your disappointment at present, I hope that Thomas Cook may be of assistance to you in the future.

So now they admit the cause to be a "breakdown" but they also consider it a "private matter to be addressed by TC" !!! (Is that legal?)
And they are seemingly inviting me to take them to court now. I'm astonished!
I have contacted CAA, who said I may have a case, and mailed the Greek NEB as CAA suggested. But I don't feel inclined to wait for them any longer.
Apart from starting a MCOL is there any other advice? Is it worth calling the legal helpline on my house insurance (with Direct Line)?

I trust you and Wendyjaycee are in touch privately as if you can avail yourselves of the airlines defence to you both and it differs even tho' you were on the same flight the airline is going to be severely embarrassed and would IMO lose both cases on that point alone. I would also be asking for costs from the judge as the airline is being arbitrary with the truth and wholly unreasonable.

do you think it is worth going back to them & letting them know that we have evidence now of two different reports for the same flight thus giving them chance to settle before court or just go for court & bring it to their attention then??0 -
well i sent off my complaint in dec 18th today i have been told i am getting 400 euros each for me and dh plus refund of our in flight meals and prebooked seats
now the question is being cheeky i know but is that all folk are entitled too? i see someone above got 50 euros to cover cost of delay at airport we were promised food vouchers which never appeared and had to pay extra would be entitled to this as well
we were delayed nearly 12 hours flown to an incorrect airport then bussed home:A VK :A0 -
Im really sorry about this but i have read through the FAQ's on the first page and a lot of it does not make sense to me as ive never had to take anyone to court before.
please can someone give me some plain english advice on what they think i should do regarding the flight delay we encountered.0
