    I have recently just came across this forum and wanted to post my story to see what people think are my chances.

    On the 26th August 2012, we were due to go on our Holiday to Florida. We arrived at the airport, checked in on time then waited.... and waited...

    Turns out our flight had "Technical Issues" which emant it was unable to arrive in Glasgwo from Manchester to allow us to head on our holiday.

    We were told after a 14 hour wait that our flight was to be rescheduled the next day, leaving us delayed over 24 hours. We were put in a lovely hotel and a basic meal was provided.

    After finding this forum, i decided to send the letters and wait on a response. What has been everyones experience on TC? I realise its not going to be easy!

    That's great, I will pm you so we can keep in touch on this. I remember it being a horrible delay sitting at a very hot and stuffy turkish airport for 6 hours. I swear the food we got from them gave us food poisoning the next day!
    It looks like they are going to drag their heels on this judging by the response everyone else got so if I've not heard from them by the 14th February with a good reason why they won't pay they are going to get a letter before action and then it's off to court. Surly they are only shooting themselves in the foot as will cost them far more to go to court?
  • hi folks,anybody who was on the 18hr delayed flight tcx245 holguin to manchester on the 29-08-12 and you have filed a claim against TC can you let me know how it's going
  • Spoke with a lass today regarding my claim, was delayed for 20hrs back in june 07 going from glasgow to cancun for a "mechanical fault" with a mytravel flight which have since been bought by thomas cook, lodged the claim 22 days ago via email and telephone and got the std 28 day response email.

    Now what happens on monday if no response, do i send a letter with all the evidence? Another thing i found out was on the flight stats website the flight code was vz15 instead of myt15 as vz was the IATA code for mytravel airways and myt was the ICAO code, its all getting complicated. At least i can prove the flight didnt leave until the following day.

    I have all the travel agent stuff for the holiday with flight times and references etc.

    Just seeking direction for the letter, being mytravel instead of thomas cook has certainly complicated it but dont think its an issue as they were bought by thomas cook as opposed to going bust.

    I have received a further response from TC giving them (another) final opportunity to explain the 'extraordinary circumstances' to no avail.
    They said,

    "... I was very sorry to read that I have been unable to resolve your complaint to your satisfaction and I have taken the liberty of reviewing the information concerning your flight delay.
    Unfortunately having done so, there is nothing further I can add to my previous correspondence , where I have attempted to address your concerns. Whilst I understand that you believe that the delay was not caused by extraordinary circumstances, I can confirm that the root cause of the delay could not have been foreseen.
    It is regrettable that we have been unable to reach a conclusion on which we can both agree. however based on the information I have available, I do not feel compensation is appropriate in this case.
    I trust I have clarified our position and I am sorry we have been unable to amicably resolve this case for you."

    So I am just off the phone to them asking if this is their final word and telling them that they have not told me what the ECs were - the advisor told me it was " a broken window heater....it had been fixed before we took off, but then it reoccurred inflight and they turned us around to Manchester."
    She said if I want to contact ABTA or the CAA and I said I knew about that...
    She said it was covered by EC and I said it wasn't but it was ok , I would just be taking them to court.

    Just want to verify now from those of you in the know, this definitely would not be classed as EC sure it wouldn't?
    and also,
    despite asking them 3 times to prove to me by way of explanation, that the circumstances were extraordinary, they plainly refused and I was only told verbally today - surely if it gets to court, this would look bad for them?
    This is from our delay in September!!
    Any advice or comments appreciated.

    Ed the duck, it's a ridiculous excuse. Off to court you go. Even if it was unexpected it's not a safety issue.

    edmacthe dog, just keep an eye on the calendar, you have to file a court claim before 6 years are up. So don't procrastinate with them for too long.

    See If you can find someone else from the same flight claiming. There have been several reports of TC and other airlines giving different reasons for the delay. Basically they are making most of them up as they go along so if you can find someone else who they have given a different reason too then you can prove they are lying! Or better still, someone who has already had compensation for that flight. They can't say yes to one and not the others!
