Unfortunately Mrs ***, We arenot able to provide you with the answers to the questions raised in yourcorrespondence detailing the cause of the breakdown as this is a private matterto be addressed by Thomas Cook
The cause of the breakdown couldnot have been foreseen prior to your aircraft departing and for that reason, weclass this flight delay as an ‘extraordinary circumstance’ and no compensationwould be applicable.
We, as Thomas Cook, stand by ourdecision and should you wish to pursue this matter further, I would thereforesuggest that this is done through more formal channels.
I thank you once again for takingthe time to contact Customer Relations and whilst I appreciate yourdisappointment at present, I hope that Thomas Cook may be of assistance to youin the future.

Can I just ask if I take TC to Court how much does it cost, and also if I lose because TC reveal EC's that are relevant do I have to pay all their costs thanks for any help.

But the best bit is, is that it is a green light to go to court. The judge cannot possibly see that you have been unreasonable, as it is up to the airline to prove that EC's exist, not just claim them as being an internal private matter0 -
Everyone check on their home insurance policy too. I just realised I had legal cover tacked on to mine which means I get a solicitor to take this on for me and cover all expenses if Thomas Cook want to play hardball. Bring it on! :-)0

Well if it's the template letter that says you're going to sue them, then go right ahead and sue. If not, then send the one about suing them and sue in 2 weeks instead.

I was your delay 22/9/2009? Cause I mine was fuertenventura to cardiff, we might have been waiting for your flight to arrive to take us backwhat reasons did they give you in cardiff, cause in fuertenventura they said nothing apart from problems with the plane and told to wait. For seven hours! With no money for food

Hi we were supposed to fly back from Goa with Thomas Cook on the 19 November but we were delayed 26 hours due to a technical fault. I sent in the relevant request for claim for compensation and I have received a written reply from them.
The usual at the beginning about regret flight was delayed.
"Although delays do occur on occasion, they can arise for a number of different reasons, and having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature, which were extraordinary, despite Thomas Cook taking lal reasonable precautions necessary to prevent the situation. All aircraft can experience technical problems that are totally unforeseen, despite all reasonable attempts to ensure they are maintained to a good standard, in line with CAA regulations. These situations can be compared to the maintenance ofyour own car, which can break down at any time without preior warning, regardless of its service history and would be considered completely beyond the owners control. As the events were defined as "extraordinary" no payment of compensation is considered appropriate in this case."

It seems TC are playing a funny game here sending out standard reply templates to everyone either claiming that maintaining a plane is the same as servicing your car (wonder who thought that gem up?) or saying that the delay was so extraordinary that they can't possibly tell you what it was as it's private!
The Oxford Dictionary definition of extraordinary is: Very unusual or remarkable:
Surely TC and all the other airlines sending out the same reply is a contradiction in terms of this definition? How can every single person on this forum have had a very unusual or remarkable delay?
It seems that it has made the extraordinary, very ordinary.0
