Hi all, just to throw some random comments in to stimulate the masses.
Firstly, I sent my claim to Harriet Green CEO of Thomas Cook Airways, a few google's found this. I would suggest that each and everyone plagarises the templateto reflect their respective case as we comment frequently that we have received the Thomas Cook generic response, when in fact they have also received the Moneysavingexpert generic template. A bit of thought and consideration saves weeks of the proverbial "tennis" me to you and so on and so forth.
From the outset I took the time to read all the threads to make an informed judgement as to how I was to tackle my attempt at compensation (and I am no expert I can tell you).
To formulate / structure your claim consider the facts, flight dates / flight number all from flight stats (Yes you have to register but small price to pay) I raised the points of specific to my journey, coupled with the relevant EU ruling, made reference to my completion of the Advanced passenger information (API) and last but not least requested a full response as to why they thought my flight was delayed but warned them this would be admissible in court.
14 days later an offer of a voucher for £700, I declined the voucher despite their attempts to negotiate such, I am now waiting patiently for my cheque. I have reminded them that I have provided all copies of the email thread with them to my brief (don't have one to be honest, but could get one) and that interest would be chargeable in the event of failure to fulfil their promise.
Please be patient and just stick to the facts......in short if your due a payout you will get it. I have read some detailed challenges on here and to be fair some do not qualify when they feel they do. So not everyone will be happy. BUT good luck to all. Happy to help where I can.0 -

Congratulations on your success. My experience has been very different however, and I know others on this forum have had a similar experience to me. TC have consistently claimed extraordinary circumstances for a technical problem with the plane for my 12 hour delay, would not budge from that position and so a court showdown looms.
Whilst not a 'scientific' poll, it is my opinion that TC are quite often paying out claims that been initiated since the October '12 (Tui/BA/Easyjet v CAA) of an earlier ruling in the ECJ, but are putting up a bitter fight against claims initiated earlier0 -

I confirm I sent one email and 14 days later an offer of the voucher which I explained Earlier in my previous post. I did exchange a few emails and suggested that was not an option and subsequently requested cash.
Honestly, that simple!! perhaps my circumstances were that Thomas cook didn't have a defence I didn't challenge anything following the offer!! Hope that helps.0 -
I think you have made some excellent points Willarikk and you have certainly made me think that there are one or two things i could have added to my own letter. But, i also personalised my own letters by adding some extra detail, which i hope should help my case.
What i also think is important and i was speaking to my partner about this. There will be some people out there who were delayed due to genuine extraordinary circumstances. I was delayed on 5 1/2 hours on a flight with TC.Sent off the template letter and received a reply 14 days later saying prove you was on the flight.Luckily for me even though it was a TC holiday I booked it at a Thomson and they were only too happy to give me my booking ref!(I had no Boarding passes etc).Sent 3 emails and one recorded letter within the next week and never got a reply, however....
Tonight I phoned Falkirk and was told the reply was received on the 16th of March and was in a long queue and to be patient as there is a backlog.I mentioned that I should have had at least a second acknowledgement, and the young chap agreed.
Question is..Do I give them any more time to respond or go the LBA route?.The guy I spoke to said hed checked my flight and no one else had claimed so was unable to give me any timescale on when my case would get looked at..is this correct?.
The flight was to Alicante on 21st August 2010 from manchester, anyone else on that flight?
gave them another call tonight,got a real snotty women telling me I would have to wait "just like everyone else" and that TC don't comply with the 28 day rule?
when I casually mentined I was considering the LBA she said "wont do you any good mate"try ABTA?
iam totally confused...help!,oh well done those successful,gawd knows how!0 -

I have now received an email I have been copied into from Thomas Cook to the mediation people,, don't know what they expect from this??
Following receipt of an Order dated xxxxxxx, we write to confirm the Defendant’s willingness to participate in mediation. We have already received an e-mail from the Claimant confirming her willingness to also participate. I have copied the Claimant into this e-mail.

TC play by their own rules. It has been noted before by others that getting into a game of correspondence tennis with them is a waste of time, they will generally string things out for as long as possible.
Suggest you go with a 'notice before action' sent recorded delivery, give them 14 days to pay up. If they dont respond, proceed with a Moneyclaimonline claim.

I agree, i would do the LBA too.
I have only just started my claim, but i know i will not be making any phone calls to them. It is pointless in my opinion. I will be doing everything by registered post or email..
