    I think you have made some excellent points Willarikk and you have certainly made me think that there are one or two things i could have added to my own letter. But, i also personalised my own letters by adding some extra detail, which i hope should help my case.

    What i also think is important and i was speaking to my partner about this. There will be some people out there who were delayed due to genuine extraordinary circumstances. It seems clear that TC are taking the michael in some cases, but it is difficult to know whether the EC claimed are genuine or not!
    I think people are taking their eye off the ball! Article 14 to quote Centipede sets the hurdle pretty high, it talks about terrorism, strikes, weather etc. The major ECJ ruling also come down pretty hard on the airlines. It is also up to the airline to prove ECs. The clue is in the word Extraordinary, yes they will happen but not to a level anywhere near to what Thomas Cook are claiming!!!!

    Not really, but if you were to tell us the flight details, then someone may recognise the info??

    Every time I have asked a question on here I found people really helpful :) like it was said before if you give the flight delays including when and where you travelled somebody might already have wheels in motion and will be able to tell you where they are up to with a claim :o

    We were certain we had booked flights with TC , and after weeks of looking for information regarding a flight in 2008 which was delayed for 6 hours,(strangely the return flight was too) we have finally had a break through. We knew the flight was mid June 2008 Manch to Fuerteventura....... My neice has found her boarding pass , flight KM 6604, 14th June 2008 departs 8:20 am Manchester. KM thats air Malta ????? ,we definately didnt book the flight with KM, nothing whatsoever on flightstat,not even a flight scheduled to leave at that time,nothing. We are now thinking that we probably no chance of a claim , if anyone could give us any info or advice, would be really be appreciated. thank you

    Geoff1057 - Air Malta contact details are here (incl email) - http://www.flightstats.com/go/Airline/airlineDetails.do?airlineCode=KM
    why not fire off an email to them indicating a claim may be on its way and see what response you receive?

    Hi

    After getting no where with Thomas Crook i decided to pass my claim on to EUClaim. After 5 weeks they have now come back to me.

    My flight was from Belfast to Cyprus which is 3,770KM. I thought that the compensation due was €600 per passenger. EUClaim company are saying that it is actually €400 because it is an intra community flight (within europe). Can someone please clarify if this is correct. I have just read regulation 261/2004 and it looks like they are wrong but i cannot be sure?

    Thanks

    Sounds to me that they are right as its 'an intra-Community flight of more than 1500 kilometres' although i'm no expert just saying what my understanding is..

    - EUR 250 for all flights of 1500 kilometres or less;
    - EUR 400 for all intra-Community flights of more than 1500 kilometres, and for all other flights between 1500 and 3500 kilometres;
    - EUR 600 for all other flights.

    Nothing to argue about, if it is over 3500 Km you are entitled to 600 Euros, knowing Thomas Crook, they will now try to shrink the diameter of the earth to get out of it. What a shower of @@@@

    Great circle from BFS to PFO shows 3710 km however you have not stated which airports.
