  • I have posted this on the main claiming compensation for delays pages, but because it is Thomas Cook I am dealing with, I thought I would put it here aswell

    Hi there.
    I am trying to retrieve flight information of a holiday I took back in 2009 I have registered and looked on the flight stats web site and there is no record of the flight that I took with Thomas Cook.

    The story is that we were supposed to take off from Birmingham Airport on the 3rd May 2009. As we have a relative who works at the airport, we found out that a baggage truck crashed into another flight due to take off for Turkey. As a result, Thomas Cook took our flight and used it for Turkey and we were all coached down to Gatwick and took off about 8 hours late.
    I don't have the flight number, just the booking reference. I have checked on flight stats under both airports and I am unable to find anything.
    I have contacted Thomas Cook but as expected they are dragging there heels as I suppose they realise that there is a claim coming there way.
    Can anyone offer any help or advice?

    The call centre is closed but they still have staff there accepting (signging for) and processing any letters sent. I've spoken to 3 people in their customer relations to confirm if the address is still the correct one to send to and they all confirm that it is and are aware that the call centre at that address has now closed.

    From my experience, the last possible moment for the acknowledgement and then their defence. Others seem to find the same, with some even (i think) finding the court received their defence after the 28 day deadline.

    My guess is that their legal department is swamped, judging by the number of poeple who have posted on here about taking their claims to court (which will likely be a fraction of the people either taking it to the courts themselves or using a claim management company to do so).

    Does the court have any discression to allow extra tine for submitting the forms/defence etc.
    If they are swamped with claims it is up to the airline to employ more staff to deal with the problem to get their paperwork in on time..
    If us as a lay claimants deliver our paperwork etc late they would employ legal experts to raise all sorts of arguments to prevent us being given extra time that we have no knowledge of.
    My claim is not with TC but in my case I am expecting that the Allocation Form may not be delivered to the court. It is now a fortnight since the due date. We phoned last week and were told it can take up to a fortnight for the court staff to log the details on the system.

    Yes, county court judges exercise a wide discretion, particularly in the small claims track. You'll be fine.
  • I have come home today to find a cheque for £1076. through my letterbox for compensation for flight delay in August 2012!! This was for 3 of us on a delayed TC flight from Kefalonia to Manchester. Thanks MSE, all it took was an initial letter, I received email from TC offering me vouchers, but I replied and said I was grateful but would prefer a chq. TC replied saying I would receive chq in 28 days and I did!! Cannot believe how smoothly this went.:j:rotfl:

    Well done! Stupid gets made me send a letter requesting a cheque!
  • I have been through the initial letter stages with TC and was told the issue was 'EC'.
    I have proceeded with CAA [standard response, will take 8 wks to investigate] and filed an NIA through MCOL.
    TC had until 9th April to respond - we're on the 11th and nothing!

    I've just emailed MCOL for confirmation as to whether they have received a response and if now my only option is to ask the court to enter judgment. I must admit, I thought they'd have folded by now..

    [EDIT] Had auto-responce from MCOL stating 10 days to return email, so phoned and waited. TC filed an acknowledgment of service, giving them till the 23rd to respond..

    Anyone else got this far into a MCOL claim??
