    My case has now been transferred to my local court as I requested on the Allocation of Service,, so thats one good thing I suppose! So annoying that everyone seems to have been told the cause of their delay and I know nothing about mine!

    I know nothing about mine either. The lady in customer services apparently didn't have the information! Best of luck with your day in court
  • I will give them 28 days to respond to my initial email as per the 1st template and if no response then I will have to find and take the next step! A lot of money here to claim back!

    Just noticed this new forum for thomas cook ( thomas crook ) heres my story on that, still not heard anything ,every time I phone they caa say im sorry thomas cook have not replied :-(, the staff at the airport told us to claim would be easy ? it is not easy and I have recieved nothing.............. I had a 23 hr delay, going to Disney World Florida, from Glasgow in August 2012. I have received nothing in compensation,

    I started procceedings against this company with the CAA whilst in America,August 2012 its now February 2013 and Thomas Cook refuses to accept blame.

    It is not easy to get compensation from an Airline, ive been getting updates every three weeks from the CAA.

    7 months on and it looks like im getting nothing, but im not giving up, Thomas Cook or Thomas Crook as I know call them, make the CAA wait for a reply.

    we did eventually get out the airport ( we had checked in and could not get back out ) and was put up in a hotel and were able to commence out holiday the next day.

    oh and they gave us five pounds for lunch, try getting a lunch for 5 pounds in a uk airport!!!

    Im not holding my breath. The crew knew the flight was not going ahead, yet we were checked in.:(

    Forget the CAA in my view, proceed to NBA, then file claim on MCOL. If TC are relying on EC's then they will have to disclose in the hearing what the circumstances are, and effectively prove the circumstances were beyond their control.

    CAA appear to be swamped and unable to enforce payment anyway.

    I and others on this forum have been fighting for months, if not years, for compensation for chronically late flights with Thomas Cook.

    In my experience the CAA are toothless, they cannot or will not make TC pay. At least you have been getting regular updates from the CAA.

    TC play a game and hope you give up in most cases. Some more recent cases (generally those cases taken up after the Tui and others v CAA in October last year) have been paid out with little of no fight, but the majority seemed to have been turned down due to TC classifying technical faults with the plane as 'extraordinary circumstances'.

    An NBA is a notice before action. Court procedures require you to write to TC giving them 14 days to pay up or you proceed to court action. Generally, advice is dont threaten court action unless you have the stomach to take them to court.

    MCOL is Money claim online. A court action intended for the small claims track of the county court can be initiated online using the court services Moneyclaimsonline website.

    Thomas Cook will fight hard, but at least one case on this forum, TC decided to pay up even though a court date had been set.

    Like others on this forum, you need to do your homework to see if you have a valid claim, and how to proceed to court.

    Cheristar: quit the multiple posts!

    Your faith in the CAA is touching but unlikely to get you anywhere: they have no power (or inclination) to bring the airlines to book. I'm not surprised you're getting no joy.

    You need to write the airline a Notice Before Action letter, giving them 14 days to settle your claim or you will commence legal proceedings. And if they do not respond, start legal proceedings!

    That is what it is going to take before you get their attention, I fear.
