    Hi , iam just about to start my claim by sending an email to TC . I made the booking in 2009 , for 4 adults and 3 children aged 14-15, flying to Fuerteventura from Birmingham. This flight was delayed for 6 hours, as was the return flight . Do I put all of our names on this email, to claim for the whole party ? and do I send a separate claim for the return journey ? Thank you ,Geoff
  • Thanks, that might help others, I cant claim due to weather, but this address was only given to me today by a Thomas Cook employee on their chat forum!!!

    What hope for compensation to others if they start fobbing you off with wrong addresses!!

    should i re-email and ask what the status of claim is?

    the reply i recieved on 24/03 was as follows

    " I am currently looking in to your case and it would appear that you are due compensation for the flight in question, However I have been unable to find your booking details with the reference number you have provided. To allow me to process your claim, can I ask you to check any documentation you still have in order to obtain the correct reference number or an alternative.

    I look forward to your reply and hope we can have the matter resolved for you soon"

    Your flight appears to be leaving LGW for Turkey. The lightening appears to relate to a different flight, i.e. a flight arriving into LGW. Therefore any defence of ECs the airline relied on would be based upon the knock-on effect of ECs, and not ECs affecting 'the flight concerned'.

    In my view you would be entitled to make a claim, based on the fact that the flight concerned was not subject to ECs - the problem was operational in that the airline did not have any aircraft available to operate your flight.

    List all the passengers on the email with DOB's and put both flight numbers on making it clear what you are claiming for. I'm presuming you were the lead passenger and it was booked in your name.

    The office address you have quoted has now been closed by TC.


    The call centre is closed however they still have clerical staff working there and accepting, processing and scanning in letters.

    I was instructed to send my request for a cheque there and it was signed for the next day, proving they do have people still working there.

    Just a note to clarify that 261/2004 claims for flight delay and cancellation are not claims for breach of contract, and therefore it's not relevant whose name it was booked in or who was the lead passenger or what their date of birth is. Each passenger has independent rights to claim compensation under the Regulation, irrespective of any contractual issue. One parent could act as the Litigation Friend of the children, representing their interests in court.

    I might be tempted to send the airline a NBA...

    thanks they responded to my first email in 22 days, tempted to give them another couple days then send an NBA by friday, might pass to a claims handling company if gets complicated

    GOt home today and there was a cheque for 1059.88 (1200 euro)

    This was for flight number tcx993
