    Hit a brick wall AGAIN - legal expenses on my insurance not covering - 2 reasons you had to be covered at the time of the incident (just changed insurance 3 months ago) so that sends me back to an old policy that I was covered under.

    Any help someone can give me - otherwise Thomas Cook have won :mad:

    Sorry if this has been asked before, I have tried looking for an answer before posting this. My question is that I can not find the outward flight number for a flight we took on 23 September 2009 with Thomas Cook, from London Gatwick to Fuerteventura. In fact I can not find the flight at all. The return flight on the same day was TCX37 and was nearly 4 hours late arriving back at Gatwick which is about the same time we were delayed going out that morning.Any help will be very appreciated. This trip was very special to me as it was the last visit I made to stay with my sister who lived in Fuerteventura and died suddenly a couple of months later in December .

    If the flight number return was tcx37 I'd put money on the ongoing flight number being either tcx36 or tcx38.

    Only 2 thomson flights show up on flightstats on the dates you've quoted.

    Yes I know, but we definitely flew out that morning very late with Thomas Cook. We were given a £5 meal voucher.

    If you know it was over 3 hours, don't sweat it: simply write to TC - who will either confirm or deny.

    I have sent a letter a week ago asking for E C onus on them, if not forth coming, it's off to court

    It was just really the amount of time delayed

    Sent off the letter template and received the usual car maintenance reply - on the 28th day. Claiming ECs with no actual details of the technical fault.

    Can I check my understanding of the regs with some of the more knowledgable posters? It is up to TC to prove the existence of extraordinary circumstances, it is also up to TC to prove they did everything reasonably possible to keep our delay to a minimum?

    Our flight was delayed 8 hours and the plane we eventually left on was in Manchester airport from Midnight until 5pm (when we left). Our original flight time was 9.30am. I have asked for proof of the technical nature and an explanation as to why we never left at our original departure time when the plane was available.

    There's been a good debate between Centipede, Mark2Spark, and myself on the Monarch thread about why technical problems are rarely "extraordinary circumstances", based on the rulings of the European Court . We worth a read for anyone taking the lark seriously, I reckon.
