  • Hi Can any one offer me some advice on weather it is worth me trying to claim?? My family went to Turkey in September 2010 with Thomas Cook and experienced a 6 hour delay due to technical issues, then once on the plane faced another delay due to a problem with the door not being able to close. How can I find out the flight number if I can not find any paper work?

    O course its worth claiming, Thomas Cook will not make it easy , but a 6 hour plus for technical reasons is on the face of it a valid case. You can get all the info you want about your flight from flightstats.co.uk. When you have that info submit a CAA template letter (found on the first page of this forum), TC will probably deny it, then its up to you to either fight it through the courts, appoint a no win no fee solicitor (who will take a cut), or walk away. As you should be entitled to between 400-600 Euros per passenger, I would not advise walking away. Good luck

    After 3 letters and 3 knockbacks ( EC and no explanation of Technical Issues ) from Thomas Crook we have now appointed an Aviation loss specialist to fight our cause. Thanks to Centipede for the recommendation. Will keep posting any more info when we find out.
  • Evening all, long time lurker, first time poster.

    Has anyone had any joy claiming against TC for the above farce?

    The flight was delayed due to the incoming plane landing in Tenerife to undergo repairs, then landing too late in the night for the airport to allow us to board it. As a result we were shipped off to a local hotel and boarded the flight exactly 18 hours late.

    On flightstats it shows that it took off without fault but 300 or so passengers could argue differently! We tried to get compensation for this the minute we got home and were fobbed off by TC and then ABTA ruled on their side!

    Was this a Lanzarote to B'ham flight? We had an 18 hour delay in March due to similar reason and I sent the standard letter off to Thomas Cook the week after we got back. They replied around a fortnight later offering me £360 in vouchers.

    I already have all my holiday arrangements for this year (and next) so replied to them that I didn't want vouchers and that I wanted the full amount claimed which was double the voucher offer (400 Euros each). Haven't had any response to that one yet but I would think that having offered the vouchers, they have admitted liability and would therefore have to pay the correct amount?

    Has anyone else been offered vouchers of a random amount, turned them down and received the correct amount?

  • thinking of using my home insurance in terms of legal cover to try and get the compensation, anyone had experience of this, only thought is someone said time limit in scotland is 5 years and not 6 for claims.

    with my legal team through legal insurance but they wont do anymore than send a few letters as dont seem convinced of success in view of the graham versus thomas cook case-i dont see the relevance!
  • Hi, I have the booking confirmation for a flight to florida in July 2010, so have all the flight information, but I have tried to find the flight on flight stat website to find out why the flight was delayed bit flight stat says the flight number in not recognised.. can I still claim although I don't know the reason for the delay?

    try looking at the route and date on flightstats rather than the flight number

    Can anyone help please? Myfamily and I were on TC flight ‘TCX031L from Calgary to Manchester on 10thSeptember 2010. Our flight was delayed for a total of 48hrs. Without going intoexact detail my first letter of complaint resulted in an eventual reply to theeffect that all this talk of compensation was down to media hype and that Ishould be a good boy and go away. Following the subsequent EC judgements TChave now fallen back on the ‘EC’ response but have since failed to respond tomy correspondence including an ‘NBA. I have forwarded my complaint to the CAAand await their response before progressing through the courts. However in themeantime I am trying to research the particular flight and the reason for thedelay.

    Two issues I have are:-

    1) I can find no record ofthe flight on the ‘Flight Stats’ website. and,

    2) Were any other ‘readers’on this flight and what the outcome of any complaints submitted.

    Your claim appears to relate to a delay caused by broken toilets. Graham & Anor v Thomas Cook Group on the other hand is for claims that fall under the Montreal Convention and damages that are too remote - neither of which touch on your claim, which is a straightforward 261/2004 statutory entitlement. Maybe mention this to your 'legal team'.

    We flew with TC from Glasgow to Orlando in July 2011. The plane had had engine problems that caused a delay at some point in the day, but this had all been fixed and the plane was ready to go for our flight. However, the prior delay had knock on effects for the crew, who were entitled to a 9 hour rest period, so we ended up delayed for more than 9 hours while the crew rested.
    We contacted TC to claim compensation for the delay using the template letter provided on this site. 6 weeks later they replied that we would not receive any compensation as they had 'Provided with welfare appropriate to the delay' (I don't think they did (one 'meal' of soggy pasta in tinned tomatoes and a glass of water in 9 hours!), but that's not the point! We only asked for compensation for the delay. Hadn't even asked for compensation for all the additional food and drink we had to purchase as I no longer had the receipts.)
    Could anyone advise me what we should do next? I think they may be being extra awkward as we had 7 people in our party so we entitled to refund of £4200.
