I would have thought you should contact them as you have a reference number (which I more than I have - I only have the booking confirmation letter). I don't know if I have enough proof as don't have boarding cards or tickets.0

I sent the Compensation claim for delayed flight template off on the 28th Feb, zero repsonse as per of April 2nd.
I also emailed a chaser last week but had no reply.
What is my next stage?
My family and I were on flight TCX 6138 on Sunday Sep-16-2012 from Newcastle airport to Reus
This flight arrived 8 hours late at Reus .

First time poster! Hi, just looking to confirm a couple of things, we were delayed for 11 hours from Manchester to Palma with TC.
How much should I claim per person?
I've filled out my letter using the template but don't have boarding passes or tickets, I do have my booking confirmation with booking reference, will this be adequate?
Thanks in advance, you guys seem to really know your stuff!0 -
Try looking in the FAQs and the links there (CAA website) to find the compensation levels
The reason folk know their stuff is because they did exactly that!0 -

having major difficulty getting my flight compensation from First Choice. Done all the correct/appropriate paperwork, company states they do not need to pay out.
Does anyone know what to do next?

Which company? If you've been writing to First Choice they are right: they don't owe you a dime.
Have you written to Thomson Airways? What have they said?0 -
I just wanted to thank everyone for all their advice and contributions on here. We were delayed flying from Manchester to Holguin in September 2012 by over 5 hours. We were told at the time that the plane needed maintenance due to a technical problem with the aircraft.
Of course, Thomas Cook have cited the good old "extraordinary circumstances" in their defence after my initial letter. So, sent off NBA letter to them and another response saying EC - won't tell me what they were though!
So, have now contacted the CAA, so will wait to see their response. If I have to go to court, I will - it seems that TC's record for delays is horrendous and hopefully this will teach them some lessons. Apart from that, we had an awful start to our holiday, sat around in an aiport, not being able to get any information from anyone and missing the first night of our holiday.
Will let you know what happens!0 -
Just wanted to say that after starting my claim back in about Novemeber 2012 and after many letters, i was offered a voucher to which i refused. Thoams Cook have now agreed to send me a cheque for £480 due to my flight delay.
To anyone feeling it is taking too long or not worth pursuing - dont give up! keep at it and you might just get somewhere. This is something you are entitled to and have every right to claim and dont be fobbed off with less compensation or a voucher.:j
If i can help anyone then please let me know0 -
We travelled to Las Vegas on 17/12/2008 Flight TCX033 and delayed at Manchester Airport for over 5 hrs. The reason for the flight delay confirmed by airport staff was a technical problem and the aircraft arriving late from its previous sector.
On our way to Las Vegas we were diverted to Ontario Airport in California due to snow at Las Vegas airport.
When I complained to TC and asked for the actual technical problem they stated it was a Spoiler Actuator (used everytime upon landing as a brake) that required replacing in Cancun before our flight. When the aircraft arrived at Manchester Airport to operate our flight to Las Vegas it required its weekly maintenance check and therefore the 5 hour delay.
We took our case to county court and lost the case as their barrister (Jack Harding) used all the alloted time so we did not have chance to put our argument to the District Judge. Their defence relied totally on the Montreal Convention (I kid you not) . The barrister just read out word for word about 3 law cases that included Sidhu v British Airways. We were granted an appeal however was caught up in the 'stay'.
My view is that the technical problem (Spoiler Actuator) is not Extraordinary Circs (EC) as its is in the normal activity of the aircraft and the weekly maintenance check is also not EC.
We cited Walletin / Sturgeon and Kramme cases.
I have recently written to TC and asked them to pay up and save themselves some cash with employing another barrister but they declined my request. Luckily we have a solicitor who has taken on the case free of charge
I have contacted ABTA, Local MP, MEP & CAA who provided no support at all although this was well before the judgement in October 2012.0
