You should not file a notice of discontinuance as, technically, and I do stress technically, this could lead to an order for costs being made against you. Far better is to write to the Court to say that the case has been settled and that you don't wish to proceed further. I know it's splitting hairs but safer. As to confidentiality, as they are trying to impose this condition after agreement was reached, this isn't binding as there is no consideration for it. . It would have been different if, say, they'd agreed to pay you an extra £200 in return for a confidentiality agreement.

Thanks for the advice 111KAB and legal magpie, I will send a letter. The flight was ZB743 Malaga - Gatwick on 15/07/12 which was delayed 6.5 hours due to a technical problem with the engine on the incoming flight.

I submitted a claim to Monarch for flight ZB655 Malaga to Manchester, 17/02/2012. Of course Monarch played the joker, exceptional circumstances and refused to pay up. I handed the claim to Botts who have finally been successful and I have now received my compensation for 2 passengers. If anyone else was on this flight, be quick and claim now before your time limit expires. Add this flight to your list of successful claims!:D

Just a quick update to my successful outcome for above flight ZB655 Malaga to Manchester on 17/02/2012. My father in law and mother in law who were on this flight decided to also now make a claim through Botts and Monarch immediately settled their claim.

Completed the template letter, sent it off to Monarch and unlike last time when we tried to claim they have sent us the claim forms to complete and return....looks promising :-)

i'm in the same position: Monarch has had my claim forms since the beginning of november, but i've had nowt but a terse acknowledgement.

Perhaps the fact that no one (or almost no one) has had a substantive reply yet means monarch are deliberating about whether to pay up, and they're just need a little more encouragement to take the plunge? Or is it that they are a bunch of shysters, trying to evade their legal responsibilities and treating their customers with contempt. Answers on a postcard ...

as i've said before, the fact that monarch are not exactly flush with money, - i think they recently published that they lost £500 mill last year - might be a factor. They might be waiting for the banks to come up with a new overdraft package.
Or a dozen other things really.
It certainly seems strange that they are taking so long to even begin denying claims on ec's, just for a start.
My fear is that they will go into administration and then any court costs i've incurred will be lost as well.

shouty caps .......... Success flight zb248 gat - sharm 14/01/2012 cracked windscreen got compensation yeh !!!
