    There was one Monarch flight into Menorca from Birmingham and one flight to Birmingham from Menorca on that date. Both say they arrived on time? Are you sure of the date and airline?

    Just seeking a little bit of guidance. As may have seen earlier in thread, Monarch originally refused to pay on our flight. We have ongoing court action against them but we were written to yesterday saying that they were now going to pay.
    Our flight was originally due to land Saturday evening but made an emergency landing at Gatwick and did not take off until the following day. However, in the meantime, they moved us from to an alternative flight from Gatwick that departed on the Sunday morning. Meaning that we arrived at lunchtime on the Sunday (instead of Saturday night). Only a few of us were put on to this flight, the others on the flight were put onto a rescheduled flight that arrived on the Sunday afternoon.


    Monarchs latest excuse is that because the flight that we actually flew out on arrived on time, then we are not entitled to compensation. That is, the Sunday morning flight from Gatwick.


    Thoughts please?

    You arrived later than your original flight time. Monarch are NOT making sense. Probably getting tangled up in their own ineptitude.
    But you say in the first paragraph they are going to pay?

    They originally wrote to us and said they were arranging settlement for our claim but they wanted a copy of our booking confirmation. We sent them this and they then said they were not going to pay because the Sunday morning flight that we were transferred onto arrived on time! Agree no sense and have gone back to them to say I think they have mixed up the rules.

    We still have ongoing court case against them so we will see.

    Flight ZB036 Mahon- Luton 05/11/12.
    This has gone backwards and forwards for over 3 years. The AESA is Spain judged that extraordinary circumstances did not apply but still Monarch refused to pay. Finally I got a court date in July 2015 but it got shifted to 2016 at the last minute. Annoying at the time but actually worked out well because other case law and rulings since obviously strengthened the case. Monarch offered a full out of court settlement, refunded all my court fees, paid compensation (at a good exchange rate too!) and even paid my travel costs as I had booked train tickets to get to Luton County Court.
    Persevere guys if you have a strong case. I almost gave up more than once (which is what the airlines want) but it's a simple, if tedious, process, and worth it in the end. Tenacity rules :-)

    Well done papllona - that's exactly the way to do it. (And shows why trying to get foreign equivalents of the CAA onboard cuts no mustard!)

    Thank you for all the useful advice on here (I've been a long time lurker), thanks to it I pursued a claim against Monarch using MCOL and having originally said they were going to defend it, they then wrote to say that whilst they were not accepting any liability, they would pay up and I have now received a cheque (quickly cashed).

    I have two questions in relation to this - firstly, they asked me to fill out a N279 Notice of Discontinuance form and file it with the court - do I need to send this - or can I just mark it as settled online? Secondly, they also said that the settlement amount and terms of settlement are strictly confidential between the parties. As I've not signed anything agreeing to that, can I post on here which flight it relates to, and how much they paid, without Monarch suddenly suing me? The flight is currently on the list of here of not paying out compensation so I'd like others to see that they should be able to get something.

    Cosmo - once the cheque clears you should fill out N279 so long as you are happy with the amount Monarch have paid and they have met and reimbursed your court costs to date. (See Legal's correction which follows)


    Once this has been undertaken you are quite a liberty to post the details - as you rightly say you did not agree to any confidentiality regarding the matter and as you suspect Monarch are trying to 'hide' the fact other delayed passengers could be entitled to compensation regarding your particular flight.
