    If the pilot cannot decide on the basis of his own qualifications that the aircraft is fit to fly then you need a proper aircraft engineer, and they are not going to be sitting around any nearer than Malaga which is about 2 hours away.

    .
    Just to point out that the pilot was perfectly happy to fly with a damaged landing light but the rules insist that an engineer inspection be made after any bird strike.

    So my on going battle with monarch is finally over .. After getting refused by them with the beyond extraordinary circumstances bull.. I left the case with bott & co as I don't have time or the know how to take proceedings further .. So in just over a few weeks Monarch have agreed to pay out with my claim .. Funny that ! So happy days and massive praise to bott & co
    I'll post the flight number up for ref.. ZB0847 Alacante to London Luton dated 26/7/14
    Thank you for all the guidance on here couldn't of done any of it without your help especially the sticky guide.

    I put in far too much time .... firstly I was determined to 'win' as I knew Monarch were in the wrong so I tried to cover every aspect and thought of every question they could throw at me. Secondly I had the time to spare so time was not important to me. I guess I spent around 40 hours researching and putting my case together.


    Was it difficult? It really depends upon your background and type of job you currently have however I found it quite easy but remain indebted to a couple of regulars on these pages.


    At times I went round in circles convincing myself I hadn't a decent case when deep down it was 100% cast iron.


    At the end of the day I need not have worried .... the Monarch case was so bad as to be laughable. Their barrister quoted the wrong clauses, he confirmed to the Judge that the normal turn-a-round for a plane at Palma de Mallorca was 5 hours then admitted he had no idea where Palma was anyway!


    The personal satisfaction in 'winning' is great - it is annoying that Monarch chose to waste my time (and theirs) in defending the case and due to the fact I had to go to court twice (Monarch were told after the first hearing to go away and re-think) the estimate of costs was around £5,000 .... what a total waste of money as my original claim was only €400 .... no wonder their flight costs are increasing, staff are being made redundant, EMA closed and their pension scheme has had a big hit.

    Took my eye off the ball so to speak with everything else going on at home. I;ve not been able to find your "bible". So if I wanted to appeal what should I do next? Get a NWNF solicitoras I don't have the time/expertise to deal with this at the moment? Or wave goodbye? Monarch said in their letter that the jammed throttle was a known fault to Airbus. Does this mean I would get a fair hearing?

    If you don't have the time to do this yourself, it's always better to get a NWNF solicitor to do it for you rather than drop the claim. This case is more complicated than many - and it's been reported that Monarch have won one of these cases before (though they've also lost two). The details are on this thread, a couple a pages back I think.
  • To Vauban, Thanks for your reply. Is there a list of NWNF solicitors that are dealing with flight compensation cases? Monarch rejected my claim because the faulty jammed throttle was known fault by Airbus and this has now been rectified. The fact that we had to wait for a plane to be sent out to Larnaca to pick us up took over 4 hours. We had to wait because the alternative plane was already on a flight to Gatwick from somewhere else. There was no other empty plane to come for us. I am surprised that no other passengers on ort flight have not complained. Have Monarch put this flight on a compensation denied list! Sorry I am rambling a bit :(
