Dear Mr Derek Macarthur,
Flight Details: MON303 14/06/2013 MAN-SFB
I am sorry to learn of the disappointment that prompted your correspondence. Providing our customers with a safe and efficient service is our first priority. I would like to reassure you that every effort is made to ensure the flights depart on time and in the unlikely event we are unable to do so, we aim to get you to your destination at the earliest opportunity. That said our ability to keep disruption to a minimum is always dependant on the resources available to us on the day.
I can confirm that your claim for compensation has now been assessed and you are entitled to compensation in accordance with EU Regulation EC261/2004 due to your delay.
In line with the above a cheque to the value of £468.18 (the Sterling equivalent of €600.00 based on today’s Reuters exchange rate) will be sent to each individual (There's five of us) :j:j claimant within twenty eight days. Please be aware that payments for children will be incorporated in the total value of the cheque forwarded to the adult who submitted the claim on their behalf.
Please note that the settlement amount and terms of settlement are strictly confidential between the parties concerned.
For your reference if you have another claim for an alternative delayed flight to the above this will be responded to separately.

We were on ZB486 to Larnaca, flew halfway across Europe only to be returned to Birmingham and left again 4 and a half hours later.
I haven't been able to find any references anywhere to other passengers taking this up with Monarch, does anyone know if are there have been any claims and how they ended up?

Your almost out of time on that one, Id suggest checking with bott and co if they will take it on0

If Bott won't take it on I suggest you download Vaubans guide and at least send a Letter/Notice Before Action as quick as you can. That gives them 14 days to reply if they refuse or try to drag it out you will have about 2 weeks before you need to issue court proceedings. Your 6 years is almost up and you must issue proceedings before the 6 year limit.
I would send the letter today and get proof of posting.0 -
Thx, yes I realised I'd have to get a move on, used the MSE Resolver tool this morning.
Update: it's now with the professionals so fingers crossed, thank you to all who passed on their advice.0 -
I would also send a letter before action as well as that will give you access to the courts should you need to go there0

Thanks for this, all good advice, I've contacted Monarch via Resolver but I will need to make sure they don't kick it into the long grass, as you say. I'm just surprised I can't find a reference to anyone taking up the delay on this flight.0

You have got 5 weeks they will drag this out unless you send a LBA. What are you going to do if they drag this out for 3-4 weeks you won't have enough time to send them a LBA before you need to start court proceedings. Your choice though. You will only find out the reason for the delay when you issue court proceedings0

As others have said, if you haven't received payment or at least a promise of payment, which would start time running again, you MUST issue Court proceedings by 3rd August or your claim will be out of time. "Issue" means that the Court has actually issued the claim. Don't leave it till the last minute0
