After having our first claim rejected I have recently asked monarch to reopen my claim under the new regulations. Sent an email last night and they have replied today to say NO still no grounds for compensation
Our records show that we had an air data system failure which left us unable to produce any long haul flight plans. This resulted in delays to our Airbus A330 long haul flying programme. Despite Monarch’s best efforts, we were unable to transfer passengers on your flight to an aircraft chartered from a third party carrier, or to an alternate aircraft from within the Monarch fleet, as would be our aim in circumstances such as this. Consequently, these events led to a delay in the scheduled departure time of your flight.

Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given.

    That is there excuse
Any advise of what to do next anyone ?
Should I contact caa or courts not prepared to give up without a fight
That is their problem. It is not unforeseeable - did they expect it to work 100% all the time?
Don't waste time with CAA - go to legal process or instruct a NWNF

    Hi David,

Thanks for your reply. Can you tell me where these FAQ's are exactly? I wouldn't normally mind paying a NWNF but it does seem to me that I have done most of the work already no?

There is a lot more work to be done - you've only just scratched the surface in terms of what is needed. Good luck with your claim whichever route you choose.

I wonder if anyone could advise me.We were delayed 7hrs on a return flight from Majorca in July 2009 .i know the flight was between 15th-18th but no other details. The reason given at the time was that a wheel had to be flown in from Luton to replace a faulty wheel on our aircraft. I know the flight should have left at around Mid-day and we didn't leave until seven-o'clock ish.we could actually see them replacing the wheel on the concourse at the time. Anyone got any suggestions please.

Anyone wanting more ammunition should take a look at the Flightstats website. One piece that I enjoyed writing to Monarch, and that I would have liked to tell the court:
Your business model involves keeping your aircraft in the sky for as many hours as possible – short turn-around times and no reserves. www.flightstats.co.uk shows that our flight, ZB978, scores 0.8 out of a possible 5, with an average delay of 88 minutes. On that basis, a four-hour delay doesn’t sound like an “extraordinary circumstance”, does it?
They caved in, so I didn't have my day in court. But it's a quote that would have looked very good in the newspapers :)
  • I just want to report that after a year of being fobbed off by Monarch for a 12 hour delayed flight in 2009, (That they admitted was caused by an engine fault, but still refused to pay up - twice they 'looked at it'). In utter frustration I turned to EU Claim/Bott & Co in September last year and have just received settlement to my account. The amount was exactly as stated, i.e. the EU specified compensation minus their 27% minus 25 euro per passenger.

I don't know what else to say, could I have have got more? Sure if I was prepared to invest the time and money taking Monarch on I would probably have eventually got more...maybe but equally likely would have been worn down by Monarch and given up, So personally i'm a happy bunny. Niggles? Well if you want to be picky EU Claim/Bott & Co tend to use the exchange rates favorable to them, but they are a business, can't blame them, just look on the extra few quid lost in the exchange as their little 'tip' I guess. Conclusion based on my experience - if you cant be bothered DIY'ing - use them or someone like them.
  • Thanks so much for this vital info CobyBenson. For some reason I just couldn't find the details anywhere (Out of interest, where did you find it?). Hopefully I can now find proof that G-MONR did operate that flight, and that our delay was purely a result of an operational decision that Monarch made, knowing that a delay to our flight was inevitable, and we would be stranded for at the very least four and a half hours.

    Adie,
Have sent you pm but do not know if you received, just in case not, the arrival and departure times, flight number and aircraft reg ( G-MONR) can be found on 'The Aviation Society' website, this show G-MONR arr on 30/09/2012 at11.25 from Sharm El Shiekh and leaving again at 12.52,if you also look on planefinder.net for flight MON5642, this will show G-MONR flying to Aktion on 30/09/2012. Hope this helps.
