    Is it worth going to small claims? Any help would be much appreciated.

    If you have a good case, based on the relevant law, it's absolutely worth it. For most people, it's the only way to get the compensation that the law entitles you to. Your AESA "ruling" suggests you have a good case. Your decision now is whether to go down the DIY route or use a no win no fee firm. Plenty of discussion of all that and more on the FAQs.

  • I am new to this forum and have read widely but not completely. Does anyone have experience of the small claims court view of a CAA decision in the Pax favour?
    We have gone through the usual hoops but have had a positive decision by CAA. Monarch of course have batted it off as it can't be enforced. I am wondering if can simply stand on the CAA decision and ask the court to enforce it rather than re-visit the 'extraordinary circumstances" argument. In any case I am off to the county court tomorrow having served a LBA.

    My understanding is that it shoud be helpful but, as the CAA themselves admit, the final decision is for the court to make. That decision will be based on the law and how that applies to the facts of the case. On that basis, you certainly can't simply request the CAA opinon be enforced. Hopefully the CAA decision will provide some ammunition for your claim. I would certainly make sure that it is prominently referred to in your claim particulars. Who knows? That may shame Monarch into paying out without going to court.

    If so can you advise on any success.

    Read the Monarch and FAQs thread and please don't create unnecessary new threads.

    The fact that someone may have receved compensation doesn't mean that you will, in any event.
  • I am also a new poster. I have made a claim to Monarch for delay of 3 hr 43 mins to flight ZB7292 LGW/DBV 9 June 2013. Claim rejected due to fault on a previous rotation with the high pressure fuel pump = extraordinary circumstance.
    What chance? County Court Summons? have advised CAA but seems that they are not much help. Any advice would be appreciated
  • I also forgot to mention that in first email from Monarch it stated that if delay was between 3 and 4 hours any compensation would be reduced by 50%, and in the latest they say all is confidential

    Crack on with the court route, or review NWNF to do it for you.

    Read thru all the FAQ, this thread and as many other theads as possible. You should then be in a postion to understand your position and how to go forward.
    What chance? That all depends on the judge on the day and possibly the out outcome of the Huzar appeal.
    50% reduction. BS by Monarch, which they keep spouting.
    Either procede yourself or engage a NWNF Co.
