    This is a technical problem with a plane - quite/very ordinary and is certainly not an extraordinary circumstance.

    I was on the return flight ZB661 Malaga to Manchester on 8th July 2012. 5 hour delay due to engine control fault. I guess this 5 hour delay was actually a knock on from your flight, which would be the outbound one preceeding mine

    Anyway, took Monarch all the way to court and they settled out of court the week before the hearing!

    we were delayed on the same return flight from corfu to manchester around seven hours, have lodged a claim at small claim court against monarch are still waiting for them to lodge their defence (they have till feb 12) although they have emailed me to say it was "extraordinary circumstances) anyone had any success with flight 3584/3585 07 and 8th of august/2009?

    Had an update on my case from solicitors. Monarch failed to respond to the LBA within 14 days, a further chaser has been sent. Will continue to update as progress is made (or not, as the case may be!)

    Just thought I would update. I sent a letter (Sept 13) registered post to NEB in Greece. After it did the rounds it was returned back to me in November... I then emailed in January 2014 and after a follow up email last week received a reply as per following:

    Dear Madame,

    Referring to your claim regarding a delayed flight in 2010, kindly be informed the following:

    According to the European Court of Justice Decisions in joined cases C-402/07 and C-432/07, C-581/10 and C-629/10, when the passengers reach their final destination three hours or more after the scheduled arrival time, they may seek flat-rate compensation from the airline, unless the delay is caused by extraordinary circumstances.

    Kindly be informed that you can take legal actions based upon the above decisions.

    We are at your disposal for any further information.

    I thought I would contact Monarch again and sent an email asking them to review my claim and said that I had received the backing of the NEB and that my next step would be to take them to court....2 hours later I received an email saying my case had been reviewed and they were going to pay me out...:j I replied and confirmed this and have had an email confirming the amount and that a cheque will be posted in the next 28 days......so here's hoping it arrives within the next month:rotfl:

    So that wasn't an LBA then, it was an LBLBA...
  • Just a bit of info for anyone having problems proving they were on a particular Monarch flight.
    I have made 2 requests to Monarch for Subject Access Requests, under the Data Protection Act - both have been ignored.
    All companies who hold personal data of customers, etc need to be registered with the ICO.
    The ICO operate a simple on line complaint system where if the airline fail to comply with your requests for information they may hold on their records regarding you, they will take action on your behalf.
    The ICO can be found at https://www.ico.org.uk.
    The penalties for ignoring the ICO are very hefty indeed.

    I saw on the first post under 'Court Success' my flight was listed.
    ZB759 Dalaman to Gatwick 22 Oct 2012 (966 & 3308) Default judgement.

    Is there a suggested next step? Thanks.

    Read the FAQs on page one, including the "What To Do Next" link.

    But your next step should be self-evident really. If the other people who got compensation for your flight got a "default judgement", this means Monarch failed to defend a legal action brought against them. There are no guarantees that they would fail to do so on this occasion, but I know what I'd do if I were in your shoes.
