  • 14:8:2010 ZB0253 Alicante to Gatwick. Just received compensation after taking Monarch to small claims court. They denied liability but agreed to pay. We had kept the form handed out in Alicante which stated delay was due to Technical reasons with their fleet, but the original denial by Monarch contradicted this letter and claimed extraordinary circumstances!
    Of interest the Court Admission form from Monarch has my name wrong and is signed MONARCH AIRLINES in a juvenile hand.....................:o

    Sent a compensation claim for a flight back in August 2006 and less than 3 days later got a rejection letter back from airline stating I had run out of time to bring the claim for compensation.

    Ive since raised another complaint with the CAA hoping they can "encourage" Monarch Airlines to sort their lives out.

    I guess Im out of options if they choose to ignore the CAA as well (assuming the CAA asks Monarch to review their decision)???

    The CAA is right - you are ought of time to bring a claim.

    I've just joined today so a complete newbie to the forum. After reading all the news regarding the right to claim compensation for delayed flights I decided I would try and claim for a couple of delayed flights....surprise surprise they were both with Monarch Airline! In fact having flow a possible 35-40 times and a good 10% have been with Monarch, I would say nearly 70% of my Monarch flights have had some form of delay... I understand the need for safety but feel that any excuse seems to suffice and us innocent flyers are the ones that suffer!
    Having read a few threads relating to Monarch I am surprised I received a response so soon from them, I sent off my letter and all appropriate documentation on the 21st January 2014 and had the standard acknowledgement in an instant reply. Furthermore today - 24th Jan 2014 I had a response back stating:

    "Our records show that the aircraft scheduled to operate your was forced to return to stand after push back for the flight to Palma. The aircraft suffered a fault with the nose wheel steering and consequently required engineering assistance before your flight could continue. As a result- and despite our best efforts to source an alternative aircraft –these events led to an unavoidable delay to the disruption of your flight.

    Having considered the factual background of this case in accordance with the published guidelines, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given."


    I realise as the aircraft was returning from Palma I cannot seek advice from the CAA?
    I decided to send an email back asking for further information to clarify their findings and to provide details of maintenance procedures of the nose wheel steering and what best efforts were made to source another aircraft?
    Sadly the response I got, was in hindsight probably expected, that they were confident that sufficient detail has been provided in order to justify the decision made. Consequently they will not be providing any further information or documentation unless requested by the Courts or relevant Aviation Enforcement Body.

    Please help?? Do I settle for this rather uninformative answer or progress further? Although not quite sure which route is best to take.... as I said I'm a newbie!
    Would appreciate any information and advice from someone with a little more knowledge please.

    I believe that's right but seeking and actually getting assistance from the CAA are two different things in any case.

    As I said, we were all new here once. The only advice I can give is to read the FAQs where absolutely everything you need is set out in very understandable terms. If you don't want to do that, have words with a no win no fee lawyer.

    MON1875 - 28/07/13


    Just shows if you stick at it you will get there eventually or maybe Monarch are starting to see the light! Hope the results encourage others to either take action themselves or at the very least contact a no win no fee firm.

    Really glad to see that there have been 3 recent successes, well done to you guys for sticking to your guns.

    I know there are no guarantees with this but MON1875 (Mytilene to Manchester) was the return flight from MON1874 (Manchester to Mytilene) which I flew out on, so fingers crossed if MON1875 has been paid out on I'll keep my fingers crossed for MON1874 !!!!

    Congratulations indeed,but as i have already stated earlier in the thread,i went to court and won earlier last year,my case was pretty compelling even before Monarch gifted me the case with information provided in their defence folder,information which they need not have submitted,because the judge was being pedantic he refused to rule on my wifes claim as she had not signed as a separate plaintiff !! Anyway we are going back to court,and Monarch using the ext circs defence (again)!! Paying a barrister to travel from London to defend a case in which they have already provided me with absolute categorical evidence that the circumstances were not extraordinary.
    So we have the cost of the defence,travel etc, plus my expenses, the courts time, the judges time and for what ? Well i am not a clever Barrister, nor a very clever judge, just an ordinary work for a wage bloke, but i know a fools errand when i see one !
    The world is a crazy place where common sense need not apply !!
