    I too was on this flight and have had my claim rejected. Now they have paid out on this flight, does anyone have any advice on how I should progress my claim. Thanks

  • Apologies Vauban, maybe I am misunderstanding. The previous poster was referring to a default judgement, whereas my flight was settled before coming to court - which I had interpreted as being different to a default judgement, as they had settled rather than defaulted. If this is not the case, I do apologise. Otherwise, if anyone has guidance on how to follow up with either the airline or CAA, it would be appreciated.

    Tilsey: did Monarch settle in Andy's case because he wrote again to the airline? Or because he wrote to the CAA? Or because he started a court action which Monarch declined to defend (like the other case I commented on)?

    It doesn't matter, frankly, whether the airline chooses proactively to settle or simply decides not to defend, leading to a default judgement. It's the same outcome - engineered by the claimant starting legal action.

  • For everyone's information I filed with MCOL and took them to the small claims court

    It was only when we got to the deadline for sumitting our bundles, two weeks before the hearing date, that monarch agreed to settle the amount out of court. I guess they read my arguments and the documents I submitted in my bundle and decided it wasnt worth defending!

    For anyone else on this flight I would suggest you do the same, fight it all the way and do your homework regarding the relevant case laws. For me the Wallentin-Hermann and Eglitis & Ratnieks cases proved my point!

    Hear, hear! It is not the onlyway to get compensation, but it is the one that offers you the best chance of success. By far.

    Thanks andythomas, really useful knowing the background to this and how you approached it. I had wondered whether they would settle all claims on a flight once that had paid out - but I know now that this isn't going to happen and need to start my homework! Great to know there has been a success on this flight ... With hopefully more to follow !

    Has anyone claimed for flight ZB684 Manachester to Sharm on the 25.08.2013 that was delayed for 4+ hours.
  • my wife and I were delayed for six hours on a flight from Palma to Manchester on 23/09/12 - after much correspondence with Monarch, CAA and AESA, I received a letter in December 2013 from AESA, upholding my claim for compensation. I spoke to Monarch today who will not pay. Is it worth going to small claims? Any help would be much appreciated.
