    It would appear that BA and Easyjet are paying out on a lot of things that Monarch are denying, like staff sickness.
    I do believe that MSE is really only the tip of the iceberg though. There must be thousands of other claims that we're not hearing about.

    Hi,
    Finally lost patience with Monarch over my claim for 7 hour delay due to operational decisions and them having insufficient aircrafts (Their words).I have issued a LBA last week and have registerd with MCOL, as i,m not the sharpest tack I was wondering if there is a template anywhere that may help me.I dont want to give them any excuse for delaying me again.

    With MCOL there are only a limited amount of words you can use in the 'box' and I'm sure if you search (check Centipede's posts) you will find the right wording for your claim. Failing that if you post your wording before submitting to MCOL I'm sure someone here (me included) will assist.

    Just to clarify a windscreen replacement is both a technical and regular problem and therefore cannot be classified as an extraordinary circumstance. In the event a screen does need replacing the time taken varies according to the plane and the availability of the replacement although replacements should be 'off the shelf' at main airports. The glass replacement is fairly straight forward however it is the glue curing time which often causes a delay (up to 24 hours) however as I say it is not an extraordinary circumstance and in the case of one airline there follows an extract from a report today where the airline concerned managed to remedy the situation within 3 hours. So firstly not an EC and even if the DJ regards it as such there are ways for the airlines to (significantly) reduce the delay period to keep it within the 3 hour 'limit'...... A SAS Scandinavian Airlines Boeing 737-800, registration LN-RCZ performing flight SK-7317 from Trondheim (Norway) to Las Palmas,CI (Spain) with 166 passengers, was climbing out of Trondheim, when the crew stopped the climb at FL180 due to the first officer's windshield developing six long cracks spanning from the top left corner to the right hand edge. The crew decided to divert to Oslo (Norway) for a safe landing on runway 01R about 50 minutes after departure.

    A replacement Boeing 737-800 registration LN-RRL reached Las Palmas' Gran Canaria Airport with a delay of 3 hours.

  • Hi,

    Just about to send my NBA letter, my flight was Venice to Manchester so under 1500km however we were diverted to Milan which takes it over 1500km, do I claim for original or amended distance ? They operated new flight under new reference number. Any help would be appreciated, thanks

    For those of you concerned regarding the EXTRAORDINARY CIRCUMSTANCES wording you may wish to drop an email to your local MEP (make sure it is your LOCAL MEP) - mine has replied as follows:-

    Thank you for your email. Commissioner Kallas is, in fact, coming to the next meeting of the Transport Committee on 19th March to present the Commissions thinking on a new passenger rights regulation following... the outcome of a recent court case at the European Court of Justice. We expect that a formal proposal will be tabled by the Commission later this month and will, amongst other things, try to provide legal clarity on the issue of 'extra-ordinary circumstances'. Until we see the actual proposal it would not be proper to speculate on how the Commission propose to tackle the issue, though we do expect the proposal to cover all modes of transport rather than just aviation. Once we have legal clarity it would, hopefully, obviate the need for court cases as airlines, in the cases cited, would not be in a position to question what is or is not an 'extraordinary circumstance.'
