That's happened with Easyjet, they paid me, then told 2 friends who were on a separate booking that they couldn't pay them due to the technical reason being extraordinary circumstances. ..'I can confirm that your claim for compensation has now been assessed and you are entitled to compensation in accordance with EU Regulation EC261/2004 due to your delay.
In line with the above a cheque to the value of £349.79 (the Sterling equivalent of €400.00 based on today’s Reuters exchange rate) will be forwarded to each claimant within fourteen working days.'
fourteen working days is tomorrow - nothing received yet!0 -

I'm not sure if I can recall 100% but I think it was a knock on delay from a previous flight with a mechanical fault. It hasn't been included in the letter. It was 8 hours though.
One of the things Im waiting for along with the cheque is to see whether they have paid compensation for my daughter, who I included on the claim form but as she was under 2, she didn't have a seat. The letter seems to imply she qualifies.0 -

Corfu airport is not the best place to spend 8 hours though especially with little children; i had 3 little ones myself and we ran out of nappies and shops didn't stock any! Disappointing customer services!

For those of you concerned regarding the EXTRAORDINARY CIRCUMSTANCES wording you may wish to drop an email to your local MEP (make sure it is your LOCAL MEP) - mine has replied as follows:-
Thank you for your email. Commissioner Kallas is, in fact, coming to the next meeting of the Transport Committee on 19th March to present the Commissions thinking on a new passenger rights regulation following... the outcome of a recent court case at the European Court of Justice. We expect that a formal proposal will be tabled by the Commission later this month and will, amongst other things, try to provide legal clarity on the issue of 'extra-ordinary circumstances'. Until we see the actual proposal it would not be proper to speculate on how the Commission propose to tackle the issue, though we do expect the proposal to cover all modes of transport rather than just aviation. Once we have legal clarity it would, hopefully, obviate the need for court cases as airlines, in the cases cited, would not be in a position to question what is or is not an 'extraordinary circumstance.'

Good idea 111KAB, I have followed your example and also emailed my MEP, and sent him a list of the flights Monarch are refusing compensation on.
The EU need to act urgently to tackle the blatent attempts to avoid the law by companies such as Monarch. It is just not good enough that individuals are left fighting this issue on their own, with no ombudsman nor other authority to assist.0 -
If you can get both names in the claimant box, then it is ok to use MCOL, this is because if they aren't in the claimant box then they aren't claimants. Airline lawyers know this and will discount claimants listed elsewhere.0
