    Just had a compensation rejection quoting extraordinary circumstances.This flight was delayed 6 hours 20 mins due to an engine fault which needed extensive troubleshooting on an aircraft from the fleet (not our aircraft, ours was used on a previous flight). We had to wait for another aircraft from another route. (which appeared to have come from straight from the 1980's, my wife even found a cigarette butt in the ashtray).
    How can extraordinary circumstances be quoted when it was an engine fault, this must be a common occurance with aircraft and there was no fault with the aircraft we should have boarded, it was used for the morning flight back to London.

I have had my claim for MON4838 (10 hour delay) on 23/01/2011 rejected on the grounds of the 'spoiler fault' which caused the delay being described as being an 'extraordinary circumstance'. I am still awaiting a response re MON4839 (the return flight for the same holiday, this time a 3 1/2 hour delay). Any idea of the best way to appeal their response? Has anyone knocked up a standard letter to argue the 'extraordinary circumstance' excuse?

    No point in appealing to Monarch - off to Court or forget it!

    Since the time limit for bringing claims was confirmed at six years, a batch of claims have been brought, mine included, and are awaiting hearing.

    Neither - you (or a selected no win no fee firm) just have to submit a court claim.
  • Two cheques from Monarch received today, one for my husband, one for me.
    We did include my daughter (under two at the time) on the claim, just to see what would happen - as she experienced the delay as much (if not more) as we did.

    What is anyone elses interpretation of Ec261/2004 with regards to babes in arms?

    (Im unsure whether to bother taking this further as morally it seems a bit suspect, she didnt pay for or have a seat, but Id like to know if Monarch are also being a bit morally suspect here too)

    ZB473 Sharm el Sheik to Birmingham 31/01/13. 27 hour delay, reason given, cracked windscreen. Claim denied due to extraordinary circumstances.
