Monarch delays & Compensations. Listed flights denied in O.P.

I have sent in my NBA and Of course I am not really expecting a response so decided to get my paperwork ready for court action when the 14 days are up.
Now this is where I'm not too sure. Would it be a small claim or summary cause? This court would be in Scotland and small claims are up to £3000. My claim goes back to 14/07/2008 and involves a family of 5 so 3000 Euros to start. My maths is just not up to working out how much interest at 8% from that date would be but I'd hazard a guess it would take me over the £3K. Anyone have any experience of this?"Sometimes life sucks....but the alternative is unacceptable."0 -

posted my original claim at the beginning of Feb this year, no reply as yet so sent in my NBA today! With my first letter I also sent a letter they had given me on the night of check-in which says....

Re: ZB647 Larnaca to Manchester
Dear customer
We apologise for the delay to your flight to Manchester today.
Due to a technical problem with the aircraft scheduled to operate your flight arrangements have been made for you to travel on an alternative Monarch aircraft and we are waiting for it to return from a previous flight.
I was delayed 9 hours plus the flight before (ZB648 manchester to larnaca) was delayed for over 4 hours!
So it seems I have a technical problem and a knock on effect. does anyone spot any problems that I may encounter?
Just checking my insurance policies to see if they will cover my court costs!
Missymoo - I was on the Manchester to Larnaca sunday flight a few weeks before this and was told (when delayed for 3 hours) that it ALWAYS left late on the Sunday - sure enough when I looked at flight stats, it leaves 30 mins - 5 hours late each Sunday (and I looked at a 4 month range)...hardly extraordinary circumstances.0 -

No, Ctrl and F but no box appears. It doesn't really matter because I know where mine is but it was bugging meI'll get you, my pretty, and your little dog too!0 -
It's quite a small letterbox in the top right on my screen?0

Centipede100 wrote: »Summary cause in the sherriff's court I believe. The value of your claim based on the exchange rate on 14/7/08 is £2400 or £480 each.
Interest can be claimed at 8% pa so this would add £192 per annum or £0.526 per day.
Crikey I hope I havn't got this wrong. I thought it was E600 per passenger as the delay was over 7hours."Sometimes life sucks....but the alternative is unacceptable."0 -

Thank you for your reply and for doing the sums for me. I'm very grateful for your help, maths has always been a bit of a dark art to me.
I got in touch with the sherrif court and was told I put in a small claim but I think I will fill in summary cause as well and talk to the sherrif clerk when I hand in my form. I'd hate to get it wrong at the last hurdle."Sometimes life sucks....but the alternative is unacceptable."0 -
2 questions.....long shot but maybe someone can help :
1)....Has anyone pursued a claim for compensation using one of these `No Win No Fee' companies??.......If so was it successful. I've had my claim rejected by Monarch due to EC - cracked windscreen...
2)..had a 7 hour delay 14/07/12 Gatwick to Malaga ZB 736
This delay had the knock-on affect of causing myself & family missing our cruise ship -that thenmeant we had to have a over night stay in Malaga & a 10 hour coach journey to reach the Ship the next day:mad: .....anyone else on this journey(ordeal) there were 60 of us !! I'd be interested to hear from you !!

It's early days to judge the no win no fee firms as no-one has reached the courts yet.
I'm not sure what money they will make though as only travel expenses are claimable in small claims court.0
