Thanks for your reply Mark, the crew on our flight said he had had an accident at Gib.What do you mean by flight by flight basis
Monarch have stated (on their Facebook page) that they were dealing with the claims on a 'flight by flight' basis.
They were asked many times what this actually meant, but they wouldn't reveal it.
It eventually unfolded (by people getting replies to claims) that what was meant was that the first claim letter opened was the first flight delay looked at. The 2nd letter was the second one, and so on.
If the flights were 2011, 2008, 2012, 2010, .... it didn't matter, it was the order in which the claim letters were opened.
Once a flight has been looked at, and a decision made, then all following letters claiming for that flight can get a quicker reply.0 -
I have just spoken to CAA regarding my claim (27 hours delay) against Monarch being rejected for EC. After several weeks, they have just told me that because my return flight (the delayed one) was from Lesbos (MON1875) they couldn't help me and I'd have to write to their version in Greece! I'm going to follow it through before I try the small claims court. Has anybody actaully had any success with taking Monarch to the Small Claims Court?
There's little point in writing to the Greek version of the CAA as they will give Monarch 30 days in which to reply, and Monarch won't reply, as there's no penalty for them not to do so.
And the Greek CAA will then rule in your favour as they haven't had a defence from Monarch.
No one has got to court yet, plenty have filed a court claim. I think the first date is in April (poster Thalia).0 -
Hi, not posted before - to add to your list ZB249 sharm el sheikh to gatwick 24/01/13 - compensation denied due to a medical emergeny of a passenger on board.
I have seen centipede's 3 options to continue my claim, does anyone think it will be worth it? I guess Monarch have a point - there were extroadinary circumstances but it was still a 19 hour delay!
Thanks for any help.:)
Typically I would say that an onboard medical emergency is an EC, therefore no claim. But with a delay of 19 hours it's certainly worth asking the CAA. You've still got 5 years and 10 months in which to claim so plenty of time yet.0 -

There was a smell of burning, the passenger next to me noticed we had turned round towards GB, and I have never seen the drinks trolley be stowed so quickly. We had an emergency landing with 6 fire tenders racing up to meet us, followed by hours of waiting, a night in an airport hotel and finally, 22 hours late, we took off again. My letter has elicited only an email inviting me to fill in their form.
My fear is that this will be classed as EC. Any suggestions?
BTW, if it weren't for the fact that I have lost all the documents, I should be claiming for yet another 22 hour Monarch delay back in 2007, when having just sustained a broken shoulder, I was kept at Toulouse (within touching distance of the Airbus factory) while a British engineer was flown out to fix a tech issue. Oh yes, and our luggage (containing my painkillers) was locked in the craft all night....
Same answer as above, still 4 years in which to claim.0 -
OP updated.
Can I ask posters to check if their flight is already on the list please? Rather than me double posting it I mean.0 -

Go to the Opening Post.
CTRL + F will give you a small search box, just enter the flight number (eg 759) and press ENTER.
This will highlight any instance of that number and even tell you how many times it appears.
Simples! And so much easier than ploughing through all those flights so carefully entered by our mentor, Mark2spark.0 -

If you can get both names in the claimant box, then it is ok to use MCOL, this is because if they aren't in the claimant box then they aren't claimants. Airline lawyers know this and will discount claimants listed elsewhere.Posts are not advice and must not be relied upon.0 -
Have a look at the Wallentin-Hermann judgement here:
http://curia.europa.eu/juris/celex.jsf?celex=62007CJ0549&lang1=en&type=NOT&ancre=
You'll see from para 11 that the cancellation of the flight was caused by a "complex engine defect" discovered the day before.
Read paras 20-27 in particular.
That's amazing, thanks so much for your help Vauban.0
