FOS response, Barclaycard PPI after 12 months

My complaint was upheld in NOV and BC had to reply to the FOS by 26th. Nov - which they didnt. The letter to BC from FOS states that if they have not heard from BC by that date the case will go to the Ombudsman.
The FOS told me I am to contact BC direct- which I did early Dec who informed me that the FOS shouldn't have said that - the consumer is not allowed to contact BC direct when the complaint is with the FOS.
I then phoned FOS and they said I must wait 8 weeks as BC had not responded and in the majority of the cases when there was no response it indicates an offer will be made before 21st. Jan (8 week time- frame)
I then got hold of the landline tel. no for BC and phoned them a few days ago, and spoke to quite a helpful lady who said they had written to FOS on 11th. Dec and the complaint was with their decision review team (they do dream up names for Depts.!!)
I then phoned FOS who acknowledged that they had recd a letter from BC on 11th. Dec and that BC were disputing the initial assessment and that my case was now with the Post Assessment Team awaiting a case worker.
I have now submitted additional information per recorded delivery- however my argument is why the FOS even accepted to consider BC dispute if the deadline had passed for them.
It seems like BC are using delaying tactics and dictating the pace with the FOS- this complaint with BC has been running 19 months!!0 -
Quick update on mine. Their original position was that "the PPI was sold correctly", but they now say that "the decision we originally made was not appropriate given the circumstances". So I've gone from being rejected to being offered just under £7000.
I sent my acceptance form back just before new year, I've checked they've received it, so it's now a waiting game for the cheque which should take 28 days.0 -

It came directly from Barclaycard. I don't think the FOS had done much investigating, I didn't get an "upheld" letter from them simply one to say Barclaycard had reconsidered.0 -

Slightly different than my case then, I've heard nothing from Barclaycard for well over a year and only the one letter from the FOS saying they upheld my complaint. It's been over a month since the FOS wrote to Barclaycard and almost 2 weeks since the fos's deadline for barclaycard to respond. Seems nothing else I can do apart from play the waiting game now and hope something gets sorted

minimaid - we are in a very similar position. First complained in July 2010. Had to go to FOS. FOS upheld in August 2012 and gave Barclay 8 weeks to pay. Since then nothing but the run around from Barclays. When we phone to find out when they are going to make an offer/or pay they tell us it is with the calculations team....we have been hearing that since October. Don't know what else we can do.0

I emailed David Chan twice and got a reply back from his office from one of his 'representatives' saying my complaint had been forwarded on to their 'dedicated ppi team' and I would hear from them shortly. Haven't tried anthony jenkins, thanks for the address.0

I'm in the same boat as everyone else here, PPI complaint upheld by the FoS, deadline set for Barclays and ignored. Several calls to Barclays with varying responses ranging from we can't speak to you about this through to we've accepted the FoS assessment and an offer will be with you before the New Year.
Interestingly I spoke to Barclaycard again tonight, another very friendly customer assistant, another chase up email to the secretive and inaccessible PPI team. After I raised the issue of failing to meet the FoS deadline they stated that they take 8 weeks from the FoS assessment to sending out an offer irrespective of FoS deadlines.
Seems like a waiting game for many of us. Barclays are clearing stretching the time frames for offers and payment to the absolute maximum.0 -
I've just had my claim turned down by Barclaycard & I've now just sent it to FOS.
Doesn't sound too promising, reading the comments on here, put I'm prepared to fight for whats mine0 -
I phoned Barclaycard today to see if there was any update since the FOS contacted them, they said no update still with the specialist team.
The chap I spoke to did say that the deadline from the FOS gets ignored, Barclaycard take up to 12 weeks from the FOS upholding the case to them making offers and closing the case.
