FOS response, Barclaycard PPI after 12 months

Hi all.

Just over 12 months ago I submitted a claim to the FOS as I was rejected by Barclaycard for mis selling of ppi on a credit card I had with them. An adjudicator has upheld my case and the letter states Barclaycard have until early jan 2013 to either accept and refund the ppi, make a counter offer or reject and have the Ombudsman review the case.

My question is has anyone else been in this sort of position, are Barclaycard likely to accept the decision or should I expect them to carry on fighting and reject the decision?

    Barclaycard rejected my complaint, I went to the FOS and they've advised that Barclaycard have reconsidered and will be contacting me soon to make an offer. No idea yet what this will be.

    The fact an independent party considers you have a strong enough case sounds very hopeful - fingers crossed for you.

    Would this be an initial assessment by the FoS? I received exactly the same from the FoS at the end of November giving Barclaycard till just before Christmas to agree with the assessment or immediately go forward to a full adjudication. It was a surprisingly strongly worded letter from the FoS. In my case Barclaycard took 6 months to reject the initial complaint (more than the allowed 16 weeks) and it's been with the FoS for the best part of this year.

    As I understand it banks rarely go against an initial assessment especially for PPI claims unless they happen to discover new evidence they've been sitting on? From this point onwards it will cost them money. Given that in my case they've had 18 months to come up with evidence to support their position it seems a little unlikely.

    Hopefully we'll all hear something positive soon.
  • I'm not certain whether it's an initial assessment for mine, I had one letter acknowledging my complaint and saying they would look at it. Then several months later, this letter which says that Barclaycard have reconsidered their position. I don't know how much communication there has been between them, or whether Barclaycard are perhaps reviewing a number of cases.
  • My letter was the "Initial assessment" recommending Barclaycard compensate me and put me back in a financial position I would be in if I had not had the PPi.

    The letter also states the decision may change depending on what Barclaycard say.

    Sounds similar to mine, mine stated that they had till just before Christmas to either:

    Accept the FoS assessment that the complaint should be upheld and either:
    Put me back in a position prior to the PPI charges
    Make an alternative offer

    Or:
    Reject the assessment and go for full adjudication.

    I called the FoS about the letter and they stated that in the vast majority of cases once the initial PPI assessment is made the bank will make an offer.

    Obviously they can go to a full adjudication but without then offering further evidence it's unlikely that an adjudicator will rule differently to an initial assessment. Unless I'm wrong as I understand it, it's at this point Barclaycard will have to pay £850 to go to the full adjudication.

    It's pretty clear that many of the banks have been using this process to stall for months and years allowing them to avoid settling and continue to make returns on money that they should have paid out.

  • When I sent the info to the FOS it also included a dispute with Morgan Stanley, after phoning the FOS yesterday it seem the Morgan dispute is still in the waiting list to be looked at despite being under the same reference number etc :(

    my ppi claim with capital one was denied so i sent it on to fos who have suggested they put my acc back into the position it would be had i not had ppi. they told C1 that they had till 21Nov to get back to fos.still no joy have rang C1
    who now tell me they have never had a letter from fos stating this. so now fos are having to forward on another letter to them. I hope we all have good news in new year. :mad:
  • Same here. Mine is a MorganStanley/Goldfish/Barclaycard.

    The FOS upheld my case in August and told me Barclaycard would make an offer in 8 weeks but 4 months on and Barclaycard are denying all knowledge of the FOS letter and are ignoring both my emails/calls/letters and the FOS have had no response from there calls/letters either. Looks like it will have to go all the way to the Ombudsman in the New Year.

    I am pee'd off. This has been ongoing now for 2 years.
