FOS response, Barclaycard PPI after 12 months

in exactly the same position as clangers ( great name by the way!) barclays have until tomorrow to respond, however when FOS sent me copy of letter sent to barclays it had some incorrectinfo ( basically it said to redress to someone that wasnt me, i contacted FOS and they advised i return letter to them, did this and called to check correct info had been sent to barclays, they couldnt answer that but said correct paperwok would be sent to me after it had been reviewed because of data protection! so who knows how long it will be, they did say even though 21st was date for reply they couldnt guarentee barclays would respond by then, seen a few similar post on here, i guess its just a waitng game, please, keep us all posted if anyone gets an updateclangers272 wrote: »Sounds similar to mine, mine stated that they had till just before Christmas to either:

I called the FoS about the letter and they stated that in the vast majority of cases once the initial PPI assessment is made the bank will make an offer.
Obviously they can go to a full adjudication but without then offering further evidence it's unlikely that an adjudicator will rule differently to an initial assessment. Unless I'm wrong as I understand it, it's at this point Barclaycard will have to pay £850 to go to the full adjudication.
It's pretty clear that many of the banks have been using this process to stall for months and years allowing them to avoid settling and continue to make returns on money that they should have paid out.0 -
Just phoned Barclaycard out of curiosity to see if they would tell me anything, apparently they have received the letter from the FOS and they have overturned the original rejection decision :eek:

That's great news, inspired by your post I gave Barclaycard a call and they informed me that following the FoS assessment they have reversed their initial rejection and my complaint has been upheld.
They are in the process of putting together an offer which they will send to me directly in early January!!0 -
Just given them a quick call, surprised they're open on Xmas Eve, and they said they've sent me an offer (!)
So fingers crossed we all get some good news to start off the new year

I sent an email complaint to the directors office in Tyneside before the holidays complaining about the wait and the phone service total lack of information and recieved a letter on Saturday saying they will be ready to 'pay' the compensation by the end of January. Although we have yet to be made or accept an offer.0

Still waiting myself, it's a very frustrating experience, my complaint has been rumbling on since June 2011. They've finally given in but just getting them to send out an offer letter is a painful experience.
They were supposed to have responded to both myself and the FoS by the middle of last December. I spoke to them before Christmas and it sounded like progress, they'd upheld the complaint and had forwarded the complaint to the appropriate department to calculate an offer and I should expect an offer by the end of 2012.
I called them again yesterday and it was like groundhog day, eventually I got them to dig a little whilst on the phone and they rediscovered the FoS letter and that I was 'on the spreadsheet' for complaints to be upheld. An email was sent to the appropriate department.
I assume it will now still be several weeks before an offer letter turns up on the assumption the complaint doesn't go missing again?
The FoS really should have some teeth when it comes to dealing with the banks. If they issue a deadline to a bank there should be a substantial penalty for ignoring it. Equally the banks are clearly passing on legitimate PPI's to the FoS knowing full well it will delay the process by months and potentially put many people off.
As a bank they are an utter disgrace and in my opinion their reputation built over the last few years is well deserved.0 -
Well as suspected Barclays have missed the 4th jan deadline, the FOS have heard nothing from them and Barclaycard say it is with the specialist team who I can't contact as they only deal direct with the FOS directly, even the people on the phone can not tell me anything!
Guess its now another waiting game and see if they actually communicate with the FOS or not
