help with letter refusing goodwill gesture please

Stephen my letter quotes both statements,"a gesture of good will", and "to accept this offer in full and final settlement" so could you suggest what i should write in reply to this as if it dose go to court i want to make sure that i reply i have replyed in the correct way.Still confused!!!!! Thank you in anticipation of your reply. W.G.

    As per title :)

    Been offered £515 from nearly a £4800 + interest claim ...... Obviously I am not accepting that, it isn't even the amount of interest that I am claiming back :rolleyes:

    There is no template because it depends on what your circumstances are, what letters you have sent them, the time scales you have imposed, what they have offered you, and how they worded the offer!

  • Although there is not a template letter to reply as such, you could send the letter from step four again and use the "have failed to receive a satisfactory response/offer" and give them a further 14 days to give you a better one.
    After this time if your still unhappy you can move onto the next step.

    Alternatively you could move straight onto step five and go to court or the FO, it really depends on your individual situation.

    I too have recieved one of these letters offering 1392.50 as a good will/ full settlement job, trouble is there 14 days were up and they never acknowledged it so I started judgement, then they wrang me and bumped it up to 2700, and told them judgement had been sent, then an hour ago i noticed 1392.50 in my account, I just dont know what to do, I thought I had won the case in court as they never acknowledged it, Im so confused Thanks Pete
  • I have typed up a letter refusing 1st offer from Alliance & Leicester. I have not yet filled in the MCOL form and really don't want to go through the court procedure if I can help it so I have typed the following letter as a last ditch attempt before claiming through court. Do you think this letter is worded correctly? All help would be appreciated.:confused:

    On the eve of my instituting proceedings against the Halifax for £554.64 (including interest) they have written and offered a payment of £231. They say: 'This offer is a goodwill gesture and is in full and final settlement of your complaint against Halifax.' , and they said that the money will be crdited to my account within the next 14 days. It hasn't been paid into my account yet.

    I have no intention of accepting this as a final settlement and am about to write a 'without prejudice' letter to them telling them I'll accept it as partial payment.

    Should I write giving them a further 14 days to settle in full before going ahead with my claim or should I just get on with it? Also, if I do go ahead with it now do I give the court the original figure or the figure minus the offer?

    Thanks in advance for any advice.

    they put my gesture payment in 4 days after I got letter, I havent touched it, and this morning got a letter saying they are not going to revise my offer and go and see the F/O, what I cant understand is I already won in court on tuesday, and they are still not playing ball, so I'll be ringing up on monday to see whats happening, my advise to you is ring them and say you will accept it as part payment, they have been helpfull to most on here, have a figue in your head of what you will accept,but be polite as there is some good ones out there, if you get no joy then file your claim Cheers Pete

I have followed Martin's steps and time limites as I didn't get a reply from letter 2 and it being after the Berwick case I wrote to the FO. While I thought possibly the Halifax could still be honourable sent letter 3 suggesting reduced amount for early closure and informing them I had contacted the FO. Now I've recieved a reply to my second letter with a goodwill gesture of £2,720 yesterday and the cheque arrived separtetly today. So help - does the acceptance of partical payment prejudice my case with the FO or prevent me taking the Halifax to Court if necessary.
