help with letter refusing goodwill gesture please

    Give them a LBA (Letter Before Action) with a Without prejudice offer like this

    Without prejudice
    The charges, interest and £30 court costs I am claiming total £175 [fill in your own figure]. However, if you are prepared to pay to me £130 (representing 75% of your original charges and interest at 4½%)[again you need to figure yours out] within 14 days of the date of this letter (and, for such purpose, time shall be of the essence), I am prepared to accept this lower figure in full and final settlement of my claim and interest.


    This 75% and 4½% worked a treat for me with Marbles Card ;)
    And IKEA Card just didn't respond to my 1st letter or my LBA so they are now paying out £175 against the £120 charges I was claiming due to it being "to costly to defend" ;)

    If you are short on cash claim the £411.29 as a claim under £500 is £50 in court fees but a claim over £500 would cost you £80 ;)

    It was shown on my statement as follows:

    OVERLIMIT FEE REFUND £136
    LATE FEE REFUND £40

    In there letter there was the suusal lawful drivel etc and as a goodwill gesture blah blah.

    I wrote to them and accepted it as part payment without prejudice but did not sign anything apart from my letter.

    Hi everyone!

    Can anyone help me with the last step of my charges....

    Basically i've sent off all the letters, statements etc.. and worked out my charges were £601 over the last 6 years, with interest just under £700.

    Yesterday a cash payment of £240 appeared in my bank account and then today a letter from the Halifax saying it's a goodwill gesture but they still don't accept they're in the wrong!

    So..... I have £240 CASH! But should i hold out for the rest or just take what i've got?

    I actually rang them this morning hastily and asked how i could return it and the guy on the phone was really, really nice, i just couldn't disagree with him so i said i'd call back later :o

    But this £240 is burning a hole in my pocket and i wouldn't like to think i could send it back then never see it again :confused:

    Any advice would be appreciated :)

    Write to them thanking for their Part Payment of your full claim! Tell them that if they fail to pay the full claim amount within 7 days, that you will take it to court. And don't forget to stick to your guns on the time scale! Give them a max of 2 days to allow for postal delays but then enter your claim on-line :)

    thanks for your help guys

    i rang him back this morning and told him that i may be willing to negotiate on the interest but no more than that, he said he'd send me out a letter confirming i wasn't accepting and that will also include anything else they're willing to offer....

    I asked him how i'd go about giving the £240 back they paid in my account and he said don't bother it'll only end up being added to anyway :D

    So with any luck i'll be getting the full amount back, thanks to everyone on here for the advice, templates and help!!

    today i have received a letter from the halifax offering almost half of what they owe me thru bank charges, need a bit of advice as whether or not to pursue the rest, please can anyone help, the letter that they sent me was offering me a goodwill offer and will put the money straight into my bank and now im in a major dilemma as to what to do now!!

    Tell them that you are accepting this money as part payment and without prejudice and will be pursuing the rest through court.

    Hi

    Have gone all the way with RBS, they have defended there claim (using cobbetts) to which i responded with the advice which was written on here (copy of statements etc.) I then received a letter from RBS offering £1022.33 goodwill gesture when infact i am claiming over £2k inc court costs. What letter shall i respond with rejecting this as i called up and they would not budge on it? and also who do i write back to? Cobbetts or RBS? I would have been prepared to accept £1500....

    There isn't a standard letter for this one. There are too many variables.

    However, as it is a gesture of goodwill, you can accept it as a "part payment without prejudice" and continue your claim for the balance. If the letter and offer was from RBS, reply to them and NOT Cobbetts (aka "Cobblers"). If one doesn't know what the other is doing, its not up to you to tell them. "Divide and conquer" as they say.
