I Started My Claim With Abbey On The 3rd April 2007.they Sent Me Bank Charges Statements From Jan 2004 -feb 2006 (which Amounts To 1850 Pounds).they Still Have Not Sent Me The Rest Of The Details I Need For The Remaining Years(6 Years Total).
They Have Sent Me A Letter Today Offering Me A 863 Pounds As A Gesture Of Goodwill.this Will Pay Off The Overdraft,i Estimate They Owe Me 5190 Pounds But They Keep Stalling On Giving Me All The Information For The Last 6 Years.
Any Advice On Getting This Information As I Will Not Be Accepting 863 Pounds As Full And Final Settlement Of Them

Hi sorry if this is in the wrong place, I need help with a goodwill gesture and I can see some great advice here already.
I am claiming the miserly sum of £120 for my mastercard charges. (I already have a separate a/c claim for £450, waiting to hear..)
I had a letter offering £50 "without prejudice" as a goodwill gesture which they have gone and put in my obselete mastercard account!!!
Is there any point in going to court to chase the rest of the money, as it is such a small amount - surely my court fees would cost more than my claim? I'm so tempted to settle, but will this have a bearing on how successful my other current acount claim is?

They Said They Will Send A "field Agent" To My House To Collect My Cheque Book And Debit Card If I Dont Send Them Back To Them Within The Next 7 Days

Could someone please point me in the direction of the template for turning down an offer and continuing to chase for the full amount due.
I am sure I saw it on one of the threads I have recently read but on looking through again I am pulling my hair out trying to find it.

PS: I am going up against Cap One, MBNA x3, Morgan Stanley and Nat West x2 - Im in for the long run no early settlements unless its the full amount0 -

Hi, it sounds like your going through exactly what I'm going through. I'm claiming alot of money through Cahoot which is a division of the Abbey. They are defending. They have offered me the poultry sum of £120 which I politely declined. Now I'm waiting for instructions from the court. All I can say is get your case prepped and use the templates in this forum. That's the best we can do. They can't justify thier charges and they know that. I wouldn't be pursueing them if I didn't know that. I have a young baby and better things to do and I'm doing this for my son otherwise I would have bottled it long before now but I see it as money they have taken unlawfully from us. Keeps me going. I am just preping my court docs now, however capital one have refunded me some money, so how do i word the court form to take account of this? This is wht i thought of below:
Charges = £ 484:00p
Interest under s.69 County Courts Act 1984 up to and including 14th June 2007 = £ 68.68p
Sub Total = £552.68p
MINUS Goodwill Gesture Paid = -£176:00
SUB TOTAL OF CLAIM = £361:29p
COURT COSTS = £50:00p
TOTAL CLAIMED = £411.29p
Or do i leave out the MINUS Goodwill figure and advise the court later they have paid £176 off teh claim?
Capital one paid this figure on 02/05 but due to lack of money i am doing the claim now.

Did you sign anything to accept the Goodwill payment?
Like "I accept this £176 in full settlement" or "I won't make a claim against Capital One"

I was sorry to read in your reply that you were unable to accept my “Without prejudice” offer that requested you need only pay back £xxx of your charges made to my account.
Unfortunately, you failed to match my offer within the allotted time, and I will now be registering this claim with the County Court, incurring £xxx court fee, requesting the charges be repaid in full with interests at the statutory rate of 8%.
May I also ask you to provide a full detailed breakdown of the costs of administering the charges made to my account. I will be asking the court to consider this cost when they make their ruling in my favour and as such failure to provide this detailed information to me will result in my asking the court to apply for the information as any charge should not exceed the cost of the breach of the contract.
