    Ask them for a final response letter and we can work on it from there. NEVER decline a refund of charges ever but negotiate if there is room to do so.

    thank you for taking the time to reply. i am not actally sure what you mean by asking for a final response letter (im a REAL lay at this). Barclays did say this to me in the letter:

    For the purposes of the financial ombudsman service, our complaint procedure has been exhausted and you may consider this letter to be our "final response" to you financial difficulty claim. Please note, you have six months for the date of this letter to refer your claim to the financial ombudsman service for investigation.

    another point i wanted to make was shall i them negotiate they at least pay my charges and leave the interest.
  • pisho, call me Nattie as I am known as that on the forums(even though I am male and even though some people call that to my face in person ;) ).
    You need to argue with the FOS since they have said it is a final response letter that a lifestyle change ie loss of job, income, having a baby etc.etc caused you to miss payments and the charges on charges left you unable to cover priority debt arrears. Remember, all charges since that lifestyle event or if you want any charges that started to impact on your ability to pay is important. If the arrears are being paid off then it may well be unlikely that they will increase any amount offered.

  • I think you guys a pretty lucky, I'm with the Halifax. I've sent all the correct letters and I'm chasing approx £2500. they have turned round and offered me £240 and to waver 3 months worth of future charges to help me along! joke really. They did say my complaint will be stored on file and will be reviewed once the courts come to a decision. I did go down the hardship route and have failed after a review of my account. but surely im still entitled to my money?

    Do i sign on the dotted line or shall i up the anti?

    Two pieces of advice.
    1) Never reject an offer since under the terms of the FSA Waiver on Bank Charges it is never going to be a full and final offer and the rest remains live until the conclusion of the OFT test case issues.
    2) If you file a county court claim then the case will be stayed anyway so it is a pointless exercise in my own opinion.
