help with letter refusing goodwill gesture please

    No you can accept it as part payment and wait for the rest. you must make it clear though that you are accewpting as part payment and not as full settlement.

    Thanks to Edinburghlass and Bailiffchaser for replying. Spoke to FO this am - happy for me to accept cheque while they go after the rest and if halifax offer the whole amount will refund them the £2,720 already paid.
    I'm now off to help friend try and get money back from Lloyds, 1 mate has had just under £900 from HSOB and awaiting offer from his Loyds account.

    I am currently claiming bank charges on behalf of my daughter. She has today received a letter offering her about a third of the actual charges claimed. Can you point me in the right direction to a draft letter (if such a thing exists) to say she wants the full amount refunded. Thanks in advance as I know the people on here will be helpful.
    Mortgage and Debt free but need to increase savings pot. :think:

    All of the letters are on the main page under reclaim bank charges if you have already asked for the charges back then you want letter 2 under step 4 that says despite previous letter you have not responded, if i do not hear from you within 14 days telling me when my unlawful charges will be refunded i will take you to court (words to that effect).If they still do not respond, stick to time limits and log a claim.Hope this helps?

    You'll find the wording for such a letter in this thread. Its likely the bank will deposit the goodwill gesture into your account and so you need to tell them you will only accept this in part payment and without prejudice and will be continuing to court for the remainder of your claim.

    I have recently started court proceedings with 'money claim online' to recoop £2500 in bank charges from Lloyds TSB ... however, Lloyds have sent me a letter since filing my claim offering me a £750 "Goodwill Refund" which they have deposited into my account. I do not want to accept this refund and wish to carry on with my court proceedings ... what do i have to do? I'm very confused:confused:

    Standard procedure from Lloyds, send them a letter saying you accept in part payment only and without prejudice and will be continuing to court for the remainder of your claim.
  • Hi all,
    this is my first post as all was going to plan until now! I have got to the stage of taking Lloyds to court via money claim. The bank defended and I have now just filled out my Allocation Questionnaire. But now I am not sure what I should be doing? Do I try to contact them and ask if they wish to make an offer? Do I sit it out and see what happens next? Or something else?
    I know from reading Martins advice and the success posts that this is all part of the process...but it makes me feel very nervous as I just don't understand it all!! Could somone please reply and relieve my fears?! Thanks.

    Thanks peeps I will write the no prejudice letter. As we are doing this through the ombudsman I will also let them know. Thanks for all your help I knew you wouldn't fail me.
