help with letter refusing goodwill gesture please

    Can you tell me how to word the letter pls? Also, can RBS do that if they have defended the claim with the courts?

    They can try a lot of things to make you go away. A lot of cases get settled out of court. However, I wouldn't budge on the amount. You could try and write something like this:

    I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges + statutory interest + court fee.

  • Recieved a letter from halifax today 21/6 offering me 1098.50 i have sent my papers through my local court asking them to pay me 2719.96 and they have sent an acknowledgement saying they are going to defend all my claim really stuck now in what to do do i fight on or will i lose all what they are offering
    they say they will send me a cheque in 14 days and to accept all i have to do is cash the cheque do you think they will go up any if i refuse and go all the way to court HELP!

    As it is a gesture of goodwill, write to them accepting it as a "part payment without prejudice" and continue your claim for the balance.
    The acquisition of wealth is no longer the driving force in my life. :)

    Sorry guys, have today had a letter from abbey saying they will refund £495 as a goodwill gesture, a total joke as i am claiming £1650, largely accrued as an error on behalf of the abbey.
    I have already done letters one and two but i'm baffled as to where i go next. Is there a template letter i can use to say no i want the rest and this is why?
    Also they have not given me any indication as to whether they will now restore tha ccount to working order or what is going on. :mad:

    I am reclaiming of mbna but they offered me a partial payment around half of what they owe me.Their letter states if they dont hear from me within eight weeks then they will consider the matter closed. I now have five working days to file for court. Will they receive the court info within this time scale. Should i write to them accepting the payment as partial payment, if so will this allow me more time with court as they then would have heard form me.

    Can someone post the accepting partial payment letter please or a link to it thanks very much for all your help!!!

    I am currently in the final stages of reclaiming my charges back from Abbey, and although as a Good will gesture, they have offered me just short of £1200 on a £7000+ claim, I have sent the Part payment acceptance/rejection depending on their answer so nothing is finalized before I proceed to court, But my main concern is that Abbey are now going down the Debt management road and demanding I clear my account asap so they can close it. Now I know I have seen a letter template somewhere regarding the harrasment from a 3rd party acting on behalf of the bank and that because the bank are fully aware that I am disputing the account as it is a lesser value than the amount we owe. Could somebody either direct me to the letter or advise me of what to put in it, as I remember reading that they could not harrass you for anything if it is in dispute and that they are acting unlawfully in accordance to some rule or another, but for the life in me I can't find it, and I'm getting really frustrated.

    Not really, just write back and say "Thanks, but no thanks" :)

    here some wording I used ;)

    I was very sorry to read in your letter of 6<SUP>th</SUP> March, that you were unable to see the cost benefits of paying my “Without Prejudice” claim.

    I will now be taking my claim to the courts via the HMCS on-line website. As previously stated, all the figures I have mentioned to date have been for the period from October 2003 to January 2007. This claim will carry a court cost of £120, which I will add to my claim along with interest at 8% to the date of the award in my favour.

    Hi there deb54 I think you should take their offer of £1800 at least its not so bad, my offer was £521.50 and the bank owes me £1673.17 thats a quarter of what there offering you. If you wanted to still go with it I would say yes but that's a good deal than what they have to offer me.
