help with letter refusing goodwill gesture please

    received offer of 1765 toal 2900 with interest and court costs, the letter gives 8 weeks to decide, my way of thinking is if i happen to chicken out or things go belly up through adverse court decisions i .will still have the offer to fall back on. do not want this to sound pessimistic but like everone else i could do with this windfall.i am self employed trying to run small buisness and this is taking over my life, everyone i bump into i seem to turn the conversation onto this topic and give them details of threads surprising how many people have not cottoned on yet.just sharing thoughts. thanks.

    Just need a bit of advice on what the next step is:-

    I am claiming £4,482.50 without interest from the Abbey I have gone through the steps with the help and advice from the forum and you guys and got to the stage where....I sent a letter to Abbey threatening to take them to court and their response that came through today was....they have completed their full investigation blah blah blah and as a gesture of goodwill are happy to refund £508, and my account will be updated within the next 10 working days. :rotfl: :rotfl: :rotfl:

    So as I said I just need a little advice as to do I write/phone/email them back and tell them no thank you I am going to be taking you to the small claims court or do I ignore the letter and make sure I put my claim in within the same 10 working days that Abbey has mentioned?

    Any help would be appreciated.

    I'll pop your post into the thread which gives you the wording for you to accept this goodwill gesture but to carry on your claim, don't ignore the letter though.

    Thank you so does that mean I can actually accept the £508 and continue with the claim minus the £508 or the full original amount I was claiming for?

    You accept the £508 in part payment, without prejudice, but will be continuing to court for the remainder of your claim.
  • Hello!!!

    As advised i worked out my bank charges which Barclays charged me, including interest it worked out to £1041.00 i received a letter this morning saying that they offer me £438.00 as a gesture of goodwill??? What am i suppose to to now??? I can either take it or request the full amount??? Please someone advise me what i should do im so confused!!!

    Hang on and I'll pop your post into the thread where you'll find the wording for accepting a goodwill gesture in part payment but that you will be continuing to court.

    Hiya

    Could someone tell me when using the template letter to accept the 'gesture of goodwill' but informing them that I will be taking them to court for the remainder of the money...do I use the paragraph below which says including interest even though the total amount I asked for was NOT including interest.

    "You may not have been aware that I commenced legal action against you for the full amount plus interest and costs on (enter date) and I would ask that you now refer this matter to your legal department for further instruction."

    I know it might sound like a silly question but I have previously been told that if it went to court and I won I would actually be offered the interest on top.

    Maybe the letter could be added with the other letter templates?

    I have received a cheque as a goodwill gesture as I no longer have a credit card with MBNA so they could not transfer the money. Can I cash the cheque as a partial payment or should I send it back as I am not accepting this as an acceptable offer??
