help with letter refusing goodwill gesture please

    Good morning world :-)

    This is my first post, but I have been reading the forums for the last few months and am currently locked in battle with Abbey, trying to claim over 3k of charges.

    Been getting usual delays, and in the process cleared my overdraft to bring my account into credit. Then got charged again, so went into the branch and closed the account.

    Got a letter today offering '£x' as a goodwill gesture!! Rang Abbey to get account status and was told account was 'still open pending' but they didn't seem to know what that meant... but they did tell me that a refund of £140 had been made. I have had no acknowledgement of closing my acount and no opportunity to reject their offer. Have submitted my MoneyClaim and awaiting Abbey's response.

    Should I write back with the standard without predjudice letter accepting the money as part payment? Because the letter did not include an amount I don't even have any written confirmation from Abbbey what the £140 dumped in the account is for! Should I hassle them to close the account as I requested some weeks ago - or just leave it to the court?

    Any advice gratefully received

    Maybe best to write a letter saying you are unaware what the £140 is for, but if it is a part payment for your claim, you will accept the part payment without prejudice and be proceeding with your claim for the remainder.

    Not sure if I am on the correct thread. Due to financial difficulties I came to a 'goodwill arrangement' with Halifax on my current account to pay them £5 per month. I owed them £2,00 in December 2006.Despite my numerous requests for them to freeze the interest I am being charged a different amount each month - ranging from £26.96 to £32.07. Is there anything that I can do as my debt is spiraling! All my other creditors including Halifax credit card have frozen the interest. Any help would be greatly appreciated.

    bank has put £380 in my account as a goodwill guesture but i asked for £966!!!

    what do i do now?

    I have submitted my request through Moneyclaim for approx £1800 inc interest and costs from the Alliance and Leicester.

    I have today received a letter with a cheque for £250 in final settlement (Insult). The letter states that they have worked out the fair cost of going overdrawn is £12 and if they take this into account then £250 is a fair refund.

    I am not going to accept this offer. Do I need to let the court know or does anyone have a template letter I can use to decline their offer. Or do I keep the cheque and write that I am persuing the rest. Help!!!
  • As the title suggests really. I'm currently in the Small claims court asking for a refund of nearly £1820 inc. interest and £120 court fees. Natwest yesterday acknowledged the claim buying them a further 14 days which now puts me upto 16 days waiting. Today they wrote me a letter offering to pay me £1156 as a goodwill gesture. I'm really unsure which way to take this.

    Firstly, if I remain silent in response to the offer will Natwest likely do the same and eventually lead me to victory? Or will this simply spur them into action and taking it all the way.
    Alternatively do I write back again asking for a full refund of what I originally asked for? I've read of people doing this and getting it back.

    Of course I could just take this offer but like I say I'm not sure which way to go. Am I likely to win if I carry on?

    Any advice or comments on this would be much appreciated. I'll keep you updated to what I do, be it brave or not.

    Although you can quite legitimately ignore them it's actually best (it looks good to the court) if you reply and either politely refuse their offer and reassert that you want what you are claiming for with no strings attached, or you can accept their offer (and forever kick yourself wondering if only... heheheh only joking!).

    No-one can guarantee you a win, but at the moment there's no reason why you shouldn't win if you carry on and follow the instructions everyone is is following. The thing is, if you are entitled to the part offer then logic dictates that you are entitled to the full amount too. Regardless of the bank's use of "without liability" we all know in the real world that they are paying out because they know they are in the wrong and have been caught with their hands in the cookie jar.

  • I'm in a very similar position (almost exactly the same!) with HSBC, have recieved a partial offer and have just written a letter declining and requesting the full amount. Is there any advice on the wording, as I'm aware that as this may eventually end up in court I need to be very careful about the language?

    Sorry if this is already out there (but I am struggling to find it!) but is there a letter template for when a credit card have sent you a payment and you are accepting it only as a partial payment and still want (and are willing to go to court for) the remainder?
