help with letter refusing goodwill gesture please

    HI ALL, PLEASE HELP.ADVISE

    Capital One sent me a letter in response to mine asking for all of the £658 back over the 6 years. Got a letter yesterday saying they have put £160 back into my account and this is the difference of £20 they were charging and £12 they are now charging. There is obviously a lot outstanding and I have not agreed to this payment at all. Do I send another letter refusing the £160 even though they have paid it in? Do I take it another level? Can anyone advise please?

    What they have done is say that all they owe is the diff between the OFT recommended amount and the amount that they actually charged. However, you can still claim the full amount back! Send them a letter saying that without prejudice you will accept the £160 as part payment of the claim, and you will be persuing the balance through the courts. hth.

    Have just started on this site so not very sure where best to write this - my first attempt didn't seem to go too well so here goes.....

    I sent off a letter to my bank, Barclays, requesting statements from my account for the last 6 years. This was the first letter just requesting my statements - not a letter regarding the amount I have been charged.
    On the 30th April I received a letter from them, part of which states:-

    'In your correspondence you have referred to elements which you feel support your claim. Barclays is aware of the information you have drawn to our attention.....'

    I couldn't quite work this out as I have not even sent the letter regarding what I want to claim back or even how much it is for the last 6 years.

    It then goes on to offer me £1,525 towards the total amount to what they said I was seeking - even though I hadn't got the statements to be able to write to them with any amount of what 'I was seeking'. It seems to me that they are pre-empting peoples claims and then sending out an automatic letter with an amount from what they have calculated.

    They also say 'If you are dissatisfied with my proposal for resolving your complaint you may ultimately be eligible to refer to the Financial Ombudsman Service'.

    I have since found out from visiting my local bank to question this that they have done this to get through their backlog of claims, and have calculated my charges at £2025.00 for the last 6 years (so their good will leaves me £500 short from their calculations). I have eight weeks to decide whether to accept this or not so have told them that I still want my account details to go over - especially as they have also sent me two letters to do with me going over my overdraft limit this month (another £60.00).

    I just wanted to get an idea from others as to whether this is a good amount for them to offer, given the total charges I have, and also if the fact that they have pre-empted their reply without me even sending a letter is likely to cause any problems in the future to do with me going through this process?

    I hope this all makes sense - your help would be so appreciated as I am really walking into the wilderness here.....

    To be honest it seems a reasonable amount of money to receive for actually doing nothing but at the end of the day it is up to you if you wish to start your claim from scratch.

    Hi ppl.

    Can someone give me a link to the forum which has template letters for accepting partial offers. Barclays have offered 645 from 1010 but haven't put it into my account, so can i still accept this offer as a partial payment and if not I also need a template letter to decline.

    The same has happened with MBNA they have put 510 pound into my account when I asked for 1111. Not happy with both offers as I informed them I would accept an amount of 850 and they are just trying to save as much money as possible.

    Any link or pasted letter would be much appreciated. I dont want to send a letter out to them and get wrong with all the legal issues that go with making claims.

  • I would also be grateful for help with a partial payment letter. I have been offered a partial payment from Capital one and do not want to accept this, I have been looking through the posts but cannot find anything.

    not sure if i have seen templates to ACCEPT claims
    im sure just a letter saying yes please credit my account would suffice ?

    I have a read of these previous posts for the wording of your letter.
  • as a goodwill payment, what do I do??? I am claiming £3987 from them so this is no where near what I am asking...

    I have sent the two letters and had a reply to the first saying basically it was tough and thats what they charge and I knew that when I opened my account... second letter no reply but today this deposit was made into my account as this - 10May07 DEP GOODWILL REFUND £750.00

    I am not sure what the next step is as I am not willing to accept this amount when I have asked for almost £4000.
