help with letter refusing goodwill gesture please

    Has anyone had this situation...? - Having followed the first steps of the process and been politely refused, I filed a claim against Lloyds through Moneyclaim for almost £2000. They sent me a letter (very promptly!) saying they were refunding me £750 as a goodwill gesture and this was their "full and final response" - and they have already put the money into my account without waiting for a response. It's extremely tempting but I don't want to accept it as I don't think it's a fair offer, especially since I had to pay court costs to get it. But it's already there! Has this happened to anyone else and what do I do - do I stay in the court process and let it run for the 14 days? What will happen then? Any advice gratefully accepted!!!

    make sure you write them a letter to say you will only accept this as partical payment and you are continuing with court claim for the outstanding amount. they done the same thing to me.

  • hiya... i need some advice please!!!! ok... i am claiming £650 +interest from abbey... i started action in febuary... also contacted fos.... i recieved a blah blah charges are lawful letter before easter... i have since written again to tell them i will take them to court, gone and got the court paperwork etc (as i cant do it online due to being on benefits at he moment and wanting to avoid paying the claim charges)... but yesterday i recieved another letter from abbey saying that they would make a good will payment of £330... to be deposited into my account within 10 days.... im not 100% happy with the amount offered...has anyone got a sample letter of how to decline the offer? or should i just file the court papers and let them deal with it? also ive looked in my account today and the money has already been deposited in there...does that mean thats it and i have to accept it? or can i still reject it?... i am a single mum on benefits.... am i best to just accept the amount? im a bit scared that i might be the 1st to loose a court case of this kind! and end up in even more debt than i alreay am!!! i would really appreciate some advice on this matter... from those who know the system better than i do... many thanks karen x

    No you don't have to accept it, but it isn't particularly easy to get the bank to take it back after a direct payment into your account.

    You can either write to the bank telling them you don't accept their offer and
    can they please remove the monies they paid in.

    Alternatively you can write to them and say that you accept the monies as part payment towards your main claim but you do not accept any conditions that come with it. The onus is then on the bank to either leave the money there or remove it.

    Whichever of the two methods you use continue with the timeline you have dictated to them. If your next step is court proceedings and you are prepared to go to court then continue with your claim as if they hadn't done anything.

  • Hi everyone, this is my first post, but can I just say thanks for all your advice and guidance, I have used this site throughout my claim, it's been a great help.
    I have made a claim agaisnt lloyds for £4800.00 and at the court stage, I received a letter stating that they were not prepared to refund the charges, and then a week later I recieved a letter telling me they were willing to offer a goodwill refund of £750.00, before I could reply to the letter the money was in my account, my concern is, How does this effect my claim now?

    You just carry on with your claim, if it actually gets to the stage when you actually have to attend court ( probably wont ) you just deduct £750 from your claim amout.
    They most likely will pay up the the balance of the claim before then anyway.
    There is also a thread on here somewhere with a template letter to send to the bank/solicitors saying you will accept in part payment and will carry on in court for the rest.

  • Abbey made a goodwill payment into my account of £285.

    I didn't do anything about it - just accepted it. Now Abbey have offered me £3000 in settlement which i have accepted, so in actual fact I've gotten £3285 from them!
