I would tend to use the F O first, as if they dont get a satisfactory conclusion you can still go to courtLast Cigarette 24/6/090

I started a claim with Lloyds Tsb bank on 07/03/07. Have gone through all the channels and ended up filing a complaint with the FOS on 26/06/07 due to really bad service from the bank. They wouldnt answer their calls and kept sending duplicate letters! Has anyone else been down this road and how long should I expect to wait? Have already had a grovelly "bear with us a while longer" letter from Lloyds which I sent straight to FOS,
Thanx!

Hi
I started a reclaim of 642 in charges and interest from LLoyds on 07/03/07. Followed the correct procedure and have been fobbed off with duplicate letters and given telephone numbers to which they dont reply. I finally submitted a complaint to the FOS on 26/06/07 regarding poor service and charges. How long does this normally take?? Doing the same with RBS and service couldnt be better after only two letters,
Thanx!

I am trying to reclaim over £2000 from my bank - I have had my rejection letter from them and have sent off the final "pay me or I will take it further" letter. I have followed everything by the letter and 14 days has passed and no reply. I want to go to the small claims court but trouble is that I live in Scotland which has a daft £750 max payout law. Im I better going via Ombudsman or is there another path I can take????
Also has anyone in Scotland been given over the £750 payout from there bank?0 -
I would go for the ombudsman. I am also in Scotland and had already put in a claim for Halifax. My total I am claiming is £1500 plus interest and have had to split it into 2 claims. The £750 amount includes any int, unsure if you were aware of that. Not sure if Halifax will pay when I put in my 2nd claim but for others I have over the £750 I am going to do it through the ombudsman.0

We use the ombudsman as routine. No cost, bundles allocation questionnaires and a much higher limit on what can be awarded in your favour. If an ombudsman rules it becomes binding on the company and to date 100% success0

After getting no joy from the Clydesdale I contacted the FOS. I have used them in the past with great succsess. Anyway the bank ignored my repeated requests for my statements on old A/C and did not cash my £10 cheque. I phoned the FOS and they stated they would write to the Clydesdale on my behalf requesting my bank charges refunded blah blah. The FOS stated I must wait 8 weeks from the date Clydesdale recieve this letter. Well 3 weeks after the FOS sent this to them they sent a standard we are investigating and are allowed 8 weeks, we will contact you before then. Wed 11th is the 8 week deadline and so far no reply. Do I ring the FOS after the post has been on Wed if they have stilll not replied?? I am still waiting for my statements also so do not know how much my claim is? In reality from speaking to the FOS untill Wednesday will be 11 weeks but I realized that the FOS send letters out in baches. So the Clydesdale were prompt in their initial response but typical of them they are now being awkward. Any ideas? Many thanks.
Ask the FO, they are the ones who will know what stage they are at with your bank.0 -

A lot of Scottish claimants have used the FO with great success. You need to have been dealing with your bank for 6/8 weeks before they will take the case on. Have a read of the FO FAQ but also check the relevant thread for your bank to see how they deal with claims at this particular stage.

I went through the Financial Ombudsman to reclaim £2,000 in bank charges from Alliance and Leicester. I received a letter on Thursday 5th July to say that the bank would rather settle out of court and are willing to pay me back the full claim. I had to sign a letter agreeing to accepting this out of court which I sent on Friday. Does anyone know how long it will take for me to receive this money back?[/quote]
Further to this, how was the money paid? cheque? straight into account?
Did you receive a letter to say when you were going to receive the money first?0 -
Phoned the FO today, they have stated that they have contacted the bank "inviting" them to make a settlement or they will continue further with their enquiries, they have given the bank 6 WKS to respond & no doubt HSBleedingC will take all the 6 wks!!
