The story: I did everything wrong & thought i'd thoroughly messed up, until i got a letter a few weeks ago saying i was to be refunded!
I didn't know the full process in order, as i had never been on this site before; so i ended up taking Yorks bank to court straight away before warning them. I didn't fill in substantial evidence (ie: dates & figures) so the bank eventually wrote saying THEY were taking ME to court for wasting their time! I got advice from this site & quickly wrote to thebank & the court with my figures etc, thinking i'd lost already. A week later they replied & settled out of court.
HOWEVER: I now need help from anybody who can advise me please:
I didn't realise that i could make a claim for up to six years, so i stupidly only claimed for a year. Can i make another claim for the remaining five years now that i've already claimed & won?0 -

yes i would.... i dont think there is a limit... what I WOULD do
is not accept the £1105.25, if they pay u return it and then claim the full 6 yrs worth.. but work it out if were talking not alot of money TO YOU!! then u decide if its worth it... but i dont think u can accept the £1105.25 then claim the remaining i would refuse it tell them a letter is on the way
etc etc
then follow from step one!

I suspect you want to get claiming before April because of the pending OFT announcement. Please dont worry about this it will not change the law on reclaiming and claims will be just as easy, valid and payable as they are now. Please see the OFT thread here :

You cant claim twice. The second claim would be defended as an abuse of the smalls claims process and struck out. I strongly advise against it.
I advise be patient, wait for your details and claim just as usual. Good luck0 -
I got the same kind of letter, although im pursuring the last £50 of my refund which the are refusing to give back, i say lets go for it and file the court claim!

Hi just a quick question. I claimed our bank charges for the previous six years about May 2006, unfortunately we have had a couple more since (not much) but can we start the process again from May 2006 to date ?0

I guess it depends on how you claimed, did you go through the courts or did you ring your bank and they gave you the money back?

After reading the posts here it seems the crucial thing is what you signed when you accepted the first time. With my first claim HSBC Solicitors quoted 'I accept the sum of £ in full and final settlement of my claim against HSBC'. I was advised to cross out in full and final settlement of my claim against HSBC which I did. As someone else mentioned I don't mind paying if I go over my overdraft but within reason, and I don't think £150.00 is reasonable. Had the OFT made the announcement expected in April and not delayed I would have left it. But it appears there could be more charges made by banks for some time. I don't want the hassle of changing accounts but also am not happy to let the banks keep ripping me off. And by the way people who go overdrawn are not stupid, when you have kids and mortgages these things some times happen. Any advice appreciated0
