    Hi everyone,

I successfully claimed back my charges on my bank account and credit cards before entering into a DMP. Now I have entered the DMP I am receiving charges etc for not paying on time and they are sending me over my limits which incurs Overlimit charges. Can I claim these back a 2nd time? Has anyone tried? Has anyone succeeded?

Only if you didn't sign a letter agreeing not to claim any future charges. Also be aware they are more likely to close your account if you claim a second time!

Surely though signing an agreement does not make it legal to make these charges. Wasn't that the argument in the first place. That even though you singed an agreement to the terms and condition (showing the charges), they are still not legal?

  • Hi Martin,

I followed your advice last year to reclaim bank charges, and was successful. I am still being charged, however; where would I stand if I put in a new claim for charges made since? Love all your advice, btw.

You need to do this again albeit be aware that unless the charges are causing you financial hardship that you will probably need to wait for the result of the OFT test case which is still going through the legal process. My name is not Martin BTW :D

Hi, i am a bit confused by this 'Test case' part, I claimed from Abbey last year and won, but like others have gone overdrawn again and been charged, I have used the letters off of here to claim again, and they sent a letter back saying about the test case, Is that all I have to do, and just wait and they will deal with it after they have ruled,or do I need to send other letters now:o ?

  • hello,

i claimed successfully for bank charges last may, but because of my terrible financial situation, i have since accrued another £800...

i was wondering if anyone knew if i could reclaim for these new charges, and if i do should i refer to my previous claim and goodwill payment, or should i just send the initial letter as it is?

thankyou for your time, i hope someone has some answers!

    Yes, of course you can
and if i do should i refer to my previous claim and goodwill payment,
No, it's not as if they won't know
or should i just send the initial letter as it is?
Yes, just follow the usual procedure.

2nd time around, they may decide to close your a/c, so a parachute a/c may be wise.
