  • Hi all, I successfully got my bank charges paid out last year from Halifax bank, however they have continued to charge me £35 for everytime I go a £1 over my overdraft and as a result I've probably got another couple of hundred in charges .... can I claim my charges back again??

I received my bank charges last year from Natwest as a gesture of goodwill but minus the interest which i had asked for. The claim was going through the courts. i did not sign the agreement from the bank which they have sent several times since stating that this was the end of the matter and i exepted they payment as full and final, can i still ask the bank to give me the additional amount of my claim which is the interest? and will the courts now accept this claim for the interest only (nearly £1000 interest owed!!)
  • I have already had one successful claim against Bank of Scotland/Halifax for around £350, but since then (because im an idiot with money) i have accumulated another £300-400 in charges, if it turns out these are unlawful will i be able to claim them back for a second time??

Hello everyone. First off I'd just like to say how useful I've found these boards over the last year - so thanks a lot! However, I've got a question that I wondered if anyone could help with.
About a year ago I claimed back my charges from HSBC. However, since then I've run up probably about another couple of hundred in charges and I just can't afford them. It's just for going overdrawn for a small amount of a couple of days.
Does anyone know whether I can reclaim this new batch? I'm happy to close my account after.
    Thanks!

I moved your post to this thread. As you are still incurring charges, maybe you should look at visiting the Debt Free Wannabe board for help and advice.

I made a claim last year on bank charges totalling around £800 for the six prior years. Since then I have had further charges, will I be able to claim these back too?
  • Hi All,

    Can anyone help me .......

In Feb '2007 I applied to claim back my bank charges from Halifax for charges that had been applied to my account over the last 2 years 7 months.

A settlement figure was reached and was paid out in full and final settlement.

In the last few months I have had financial difficulty due to money that I was expecting wasn't paid which caused me to go over my agreed overdraft and received charges. I am being charged £35.00 for each transaction and some of them are for a few pound. There is not limit on how many charges they apply each day and I am now in a position where I am in a downward spiral of increasing debt.

My question is ...... as I have already claimed last year for the last 2 years and 7 months can I claim again or does full and final settlement mean any charges that I might get ?

    Any advice would be appreciated.
    Thanks

The interest is only awarded by the court should your claim have gone that far and is not part of a charges claim so no, the court won't accept it.

As regards further charges, this is from the FSA website...

have already had a settlement and want it reviewed
A full and final settlement is just that – it is final. In some exceptional circumstances a complaint can be reviewed (for example, if there is evidence of coercion or bullying). However, you can still complain about any new charges incurred since that settlement.
