  • Just a point to think about....

    When you are successful in claiming back your charges, or part of them, the bank will ensure that you sign an agreement in full and final settlement, this will also include a statement that you will accept future charges.

    Now, like most people, I signed to get my money and have subsequently received a bank charge in the last couple of months, despite being careful not to. I rang the bank to dispute the charge and they were keen to draw my attention back to the settlement clause regarding accepting future charges.

    My argument here is that fundamentally bank charges are unlawful, so even if signing an agreement, they are still inlawful and I am sure that no court would argue in favour of the bank. So, is it right and lawful to relclaim again??

    The agreement I signed was as follows

    "I accept the sum in full and final settlement of my claim against HSBC for the charges applied to my account in the period Oct to Jan. I agree not to make any other claims relating to charges for the period stipulated above. I also agree to keep the fact of my cliam and the ex gratia payment made my Hsbc strictly confidential."

    My understanding is that anything outside these dates is okay, right?
  • About a year ago I wrote to my bank about bank charges threatening to claim back six years charges unless it refunded the latest charges (which amounted to about £90).The bank sent me a letter offering £400 in full and final settlement and which I had accepted. However, since that settlement the bank has continued to charge me on overdrawn balances. Can I pursue a new claim for these current charges.

  • I bank with Natwest, I successfully reclaimed 100 % of my charges in March. I have accrued approx £150 in charges since. On one occasion I was charged £58 in one month for being £2 overdrawn.
    I rang the lending dept. when I was charged and the guy who I spoke to asked if I had sent a letter requesting my bank statements, I told him that I had done earlier in the year, yes and that it had been settled.
    He said that they would not offer me any goodwill gesture and that the charges were in line with the T&C's of my account.
    Does this mean I have lost the right to reclaim further charges?
  • I have just been through a fairly lengthy 2 month battle with Natwest, to reclaim my bank charges. After having sent a court action threaten letter, which was my second letter, They agreed to reimburse the charges. The amount which I had refunded was the full amount that I claimed, which was £2120, as they submitted an offer letter for the full amount, so I obviously agreed. The letter stated the usual rubbish: "we will refund these charges back to you, but without admitting liability and if you have any issues with charges in the future, we suggest that you make alternative account arrangements"

    A couple of months later, I went over my limit for the first time after my refund was issued and noticed that they had again deducted some charges:mad::
    Do I press them to get these charges refunded or am I stuck? Has anyone had any success in claiming against the bank (particularly Natwest) twice successfully?

    That means, if you have anymore charges, you'll have to find yourself another bank.
    I would do that straight away, they might close your account. Particular if you ask for another refund.
  • The usual response to a second claim on the same account is to close it. As Begal says you need to open another account now before they force you to close it.

    You may get your charges back but don't be surprised if the Bank unilaterally closes your account.

    Hi guys!

    I successfully claimed quite a sum of money from HSBC last year and managed to go back over my o/d limit since. I know that on a 2nd claim I may get my account closed but thats fine as I've opened another with Natwest.

    My question is, can I claim again as last years claim was for 6 years worth? Surely if I claim again for the last year then I would have claimed back 7 years?

    Any help is greatly appreciated!
