I wondered whether someone could help please?
I have used this sites template letter to request previous statements from my bank in order that I can reclaim bank charges over the past 6 years.
It seems they are using a delaying tactic to minimise the amount they have to pay out as a decision will be made by next month as to how much the Bank should charge.
I wrote to the bank a few weeks ago sending £10 to cover administrative costs to provide the statements. Today I have received statements only for the past 12 months - the bank "claim" they have no records of any others. I already have all the recent records (most people tend to keep the most recent and throw away the old!) so I feel I have been cheated by them and have wasted my money.
Is this an infringement of the Data Protection Act? They seem to claim now that most of the older documents are stored on microfiche and it is impractical for them to provide such information. Surely the last few years are still kept on computer? Is this a ploy the bank have suddenly had to devise in order that they don't pay all the money out to frustrated customers?
Your thoughts/ suggestions would be most welcome.

This is a delaying tactic and Abbey National are misleading customers here.
The Information Commissioner has already ruled that information on microfiche is a relevant filing system under the Data Protection Act.
Write a letter to Abbey stating that they are in breach of the DPA if they do not provide this information. Remind them the IC has already ruled they must provide information on microfiche. Let them know any further delays wil result in a complaint to the Information Commissioner and you will use the court to enforce the Act in necessary.0 -

They cannot issue it to you as microfiche, which they might try to delay and confuse you. They must, under the act, represent it in comprehensible form i.e: on paper as a list.

I also have received this letter from the abbey, along with only the past 12 months bank statements. my 40 days are not up yet, but should i send a letter to them before the 40days or should i wait?0 -

Send the letter now as they have the 40 days to complete the task in its entirety and have failed to do so. Dont give them any more time, they knew exactly what they were doing in delaying. Good luck

hello, this is my 1st time here so please bear with me.
I have had trouble with the abbey to. I sent them the letter asking for my
statments and after 20 days that was yesterday i called them to ask if they had got my letter and if my statments would be on the way they said that they do not take cheques and that they had'nt even got my letter they did say that i could go to my branch and pay the £10 in cash as i did not have it in my acount you see becouse they keeb charging me i am over my overdraft. I went to my branch in the afternoon to do that and they did'nt have a clue what i was asking for it took me half an hour to get it sorted.
I am now confused as to how long i have to wait to take it to the next step and if they are just trying to delay things.

Hope someone can help - I have sent off the first letter requesting my statements for the past 6 years from the Abbey for both my accounts - I have received only 1 years statement for both accounts and a letter stating - "any previous transactions have been archived onto microfiche and will not be possible to provide me with a computer print out of this information, however arrangements have been made to send a list of archived transactions between 2001 and 2005, under seperate cover." - not sure what this means - do I just wait and see what the postman brings I have also sent off the first letter to the Nat West but have only received statements from 9/1/01 to 4/10/02 should I send a second registered letter requesting the other statements - has anyone else had these problems0

Has anyone out there had trouble with Abbey sending copy bank statements showing NO bank charges, when you know for a fact you have been charged and have some evidence to that fact0

I requested six years of bank statements from the Abbey and have received 13 from last year, showing NO bank charges, when I still have a few originals showing I have incurred them! The rest are stored on microfiche and will be sent in due course, although they say a list of archived transactions will be sent for the years 2001 - 2005. Has anyone had a similar experience with the Abbey. Also I have yet again been given bank charges this month of over £80 as a regular transaction was a day late into my account, despite the fact also that my salary is paid on a weekly basis also.0
