Hope you can help!
We first wrote with the first template letter to Abbey on 14th March and rreceived replies saying they were looking into it and luanching an investigation.... Then they sent a letter saying that they would send what statements they had on file to us (which ressulted in 3 months Jan, Feb March 2006) bearing in mind we are a on a DMP with CCCS and this account has not being touched for over 16 months. Anyway, they say the rest needs to be got from microfiche. I called to chase this up on Saturday and they said that the request is still going through... now the reason I post..... We recieved this letter today. Oh i don't know how to post it...
Anyway, the jist is that the they are sorry we are unhappy with the charges but they are not prepared to refund them and blah blah about how they kept us informed about charges. we knew when opening acct etc etc. They have done a full investiagetion and if they do not heare from us in 8 weeks they will close the file. Now I can;t tell them I will take them to court for the amount as I have no idea what it is! I have tried calling their number but it is constantly engaged. What shall I do next? Sorry this is a bit rushed, but I am at work and need to leave shortly or I'll be kicked out!!! I have written to Abbey requesting a list of charges having sent a cheque for £10 standard fee they cashed it but i have not recieved the list of charges that apply to my account. However i have just recieved a letter saying that they were correct in charging me at the time and have said that I was informed of the charges and that there was no complaint to answer to. I was wondering what i should do next as i have still not recieved the list of charges for my account over the period of the last 6 years? Also i sent my letter asking for the charges on the 6th of March 2007 and i recieved a response on the 19th April 2007.0

Hi Lambton,
If you have not recieved any statements you have requested send the next template letter - step 2 - (Telling Abbey they have failed to provided the requested information and have now breached your DPA rights and therefore if you do not hear from them in 7days you will report them to the Information Commissioner)
If you post the rest of your queries in this thread - Abbey merged - on page 3 - you will get a better respones to help you0 -
i just received the statements from abbey but were 18 missing statements what can i do? also abbey is sending mail to mi on my wife name and my bank details in the letter :mad:0

Has it been 40days since your 1st letter was sent requesting statements? If so send the 2nd letter saying they have breached yours rights under the DPA and you will therefore have to report them to the information commissioner if you do not recieved statements within the next 7 days.
The letter Abbey have sent you about not being prepared to send charges sounds like a delay tactic and anyway if you have only requested statements they shouldnt be saying they are not going to be prepared to refund when you havent yet requested this.

I have written letters to the Abbey National requesting the last six years of charges etc. for 2 accounts.
On Friday 31 days into the deadline they have sent one tears statements for one account.
I have prepared a final letter to send by Recorded Delivery pointing out due to their delay they will on receipt have only 5 days to respond.

I am dealing with Abbey National and have just received literature from their head of Banking Services so I have copied the letter to her.
I became totally disillusioned with them when I went to ask for a Bankers Draft from them and was told because it exceeded £5,000 I had to pay £10...I refused and another cashier said " oh just give her a counter cheque " as if I wasn't in the same room!
She then asked for my pass book and I told her our books were lost in a fire 10 years ago and we refused to replace them as they were going to charge us £10 for each book and pointed out they'd been dealing with us for 10 years without a pass book. She said the only way I could get my money was with a book or if I closed my account and for the first time in a bank I got a buzz watching her face as I said " OK close it then " and they had to give me a cheque for several thousand pounds simply because they had tried to squeeze another few ponds out of me charging me to remove my own money.
It was a step too far for me which is why I am doing this.0 -
I wouldn't have sent a second letter. If you don't get your statements in the 40 day limit, contact the Information Commissioner.The acquisition of wealth is no longer the driving force in my life.

Hi, i recently phoned my bank (Abbey) and applied for my last 6 years worth of statements. They sent me a letter basically saying that they don't store the information on thier systems anymore and that they could give me the last fourteen months worth - which they have done. However, there aren't any charges on my account during this period.
I've been advised to write back to them demanding my statements and threatening to take them to the small claims courts but i'm not entirely sure how to go about this. Any help would be greately appreciated.
