Sent my papers to court on friday 26th may who served Halifax the papers on fri 1st june so have until the 15th for halifax to make there minds up.

Lady i spoke to from the courts said that the judges have been told to keep all claims on hold for now, and so alot of backlog is building at Southend county court.

She also said alot of the banks are settling before court date is set anyway, so fingers crossed, i should here from the banks about my 5k within the next week.

Oh my god, hows my luck! received a letter from the courts on saturday morning telling me Halifax has filed a defense, i know they now have an extra 14 days which brings it to the 28th June but what do i do now? do i just wait until the 29th day? do i have to prepare anything, i.e court bundle? if so what do i have to have in my court bundle? any advice please as i now feel this was all a bad idea and going to lose the 5k i was sooooo looking forward to receiving back.

Dont panic, I doubt you will lose. Its just another step in the dance. The bank could either
file a defence ( then pay up before court date)
    Pay up ( whoopeee)
Not file a defence ( then you request judgment by default)

It wouldnt do any harm to read up on the court bundle and what you need to put into it, but hopefully it wont get that far.

    Then just wait it out.

    GOOD LUCK

Well i have my judgment against lloyds so i called SC&M and they told me that they may apply to have it set aside!!!!
    So the waiting goes on.
Lloyds do seem to be a bit slow in acknowledging/defending, but from what ive seen in here, they usually defend very soon after acknowledging so with a bit of luck you too may have slipped through the net.
    Fingers crossed, Good Luck

What does that mean (set aside)? I was hacked off because i thought i'd rightly won judgement by default then 4 days late while my judgement was waiting to be processed Lloyds enter an acknowledgement and the courts process it against me !!

Hope I have but i'm not counting my chickens :rotfl: its Lloyds isn't it !!!

It doesnt seem fair. We get everything in by the deadlines then they can swan in with acknowledgments days late and it still gets processed!!

Then ( as in my case) you think youve got it in the bag, they can get the judgment overturned. If they do get it set aside i have to start all over again!

Hopefully it wont happen and i will have my £5322.91 very, very soon!

Spoke to the court today, they said that the judge is dealing with a block of 70 peoples cases on the 27th June and so this may mean that this court is going to make a decision to set a president with just hearing one case, bit scary and not so sure that this is fair but nevertheless my bank has until the 28th June to file a defence, so if they wait till then i will be dealt with in July's batch of people (taking it that the judge hasnt already made a block decision) if they file before the 27th then i will be dealt with this month.

He seemed quite confident that the bank will pay up before court date but did say that 1 or 2 people hadnt been successfull in the past in that court, so quite daunting for me.

Would be grateful if anyone could highlight a 'court bundle' thread as i cant seem to find one.
