Have the banks got 8 weeks to reply?!!!

  • Hi Can anybody give me advice on what to do next I recived a letter from TSB saying that they were still looking into my bank charges and will be writing to me on the next FOUR WEEKS with a response to my complaint with my bank charges this is the 2nd letter from them saying this.
    Do I just sit back and wait or what can I do.
    Ihave gave them the list of charges.:confused:

    They have entered you into their standard complaints procedure and they are allowed 8 weeks to reply. You dont have to follow this and can stick to the timescales laid out in the main article and template letters. Good luck :)

    I'm in the process of claiming charges from the Halifax. I've sent the letter asking for the cash with interest and they've sent one back telling me they'll look into it. They state that the FSA gives them 8 weeks to reply, but they'll really try to do it in 4 weeks.

    Is it worth me waiting the 4/8 weeks, then threatening them with court if they don't cough up? or should I give them only the 14 days I said I would in the letter?:confused:

    I'm not really sure about the FSA and whether I should sit tight for a little while.

    Any advice is greatly appreciated.:wink:

    They have entered you into their complaints procedure and that is governed by guidelines set down by the FSA but you dont have to follow them. It would really only be relevant if you were using the Financial Ombudsman to investigate your complaint and intended to follow that process, giving them the relevant timescales for that and exhausting their complaints procedure before reporting it to the FO for further investigation/complaint.

    However, since you are instead using the court process, you only need to show in court that you have given them sufficient time to respond. Martins article and template letters are tailored to this requirement and so you should allow the 14 days and then proceed to the next step. Good luck :)

    with a reply to the effect that they will get back to me but that it could take up to eight weeks! This sounds like a stalling tactic to me. Has anyone else
    had a similar response? shall I ignore and go ahead with Writ or what? any
    advice gratefully received. The Bank is Barclays.

  • not sure.. i have asked the same qustion on another thread my banks abbey and they want me to wait another 4 weeks, think i will threaten court action tomorrow.

    You're not really being fobbed off but they know that you wont find this acceptable. Technically they are allowed to take 8 weeks to deal with your complaint as per the guidelines set for them by the FSA. This is relevant if you are going to use the Financial Ombudsman as you must exhaust the complaints procedure before referring the complaint them to deal with.

    As you are going the court route then these timescales do not apply and you only need to satisfy the court that you have given ample time for them to respond to your claim. Continue with the process laid out in the main article and timescales laid out in the templates. Your next step is to send the LBA (letter before action) so good luck :)

    It is not a stalling tactic as such. The banks are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. This is only relevant if you were to use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.

    As you are using the court route then there is no requirement to follow those timescales yourself. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim. Follow the process laid out in the main article and timescales in the template letters and good luck :)

    Can anyone advise me......I think I'm being messed about by my bank?

    I'm in the process of taking the Royal Bank of Scotland to court (sent 2nd template letter 3 weeks ago) and after I telephoned them for an update, they have advised me that they are "investigating my case and that they are legally allowed 8 weeks to deal with my enquiry/claim"?

    Has anyone else been told this by their bank and should I wait this l ength of time (i.e 8 weeks) or proceed now with the court letter?

    Would appreciate any feedback/advice, thanks.
    i waited the 8 weeks with HSBC and received an initial offer right on the 8 weeks, wouldnt pay the interest and offered me another 100 on top for charges to date that were not listed on original claim, ranf them asked for 200 more as the latest charges amounted to 300 they agreed on the phone and even told me what to write word for word to have the extra 200 added to the amount they would pay me. A couple of phone calls to the banks customer service dept were well worth the time on hold very helpful and saved me the hassle of court. Think they are actually taking the full 8 weeks as there are so many claims.
